Declaration of Emergency

RESOLUTION NO.79-05
WHEREAS, The County Director of Emergency Management reported that
beginning December 23,2005 heavy precipitation in West Jefferson County resulted in
high runoff on local rivers and streams, and,
WHEREAS, The Jefferson County Department of Public Works determined that
the runoff and subsequent related weather events resulted in erosion damage to the South
Shore Road at approximately MP 0.6, and,
WHEREAS, channel scour from further runoff and rainy conditions in the near-
term could likely worsen the integrity ofthe already damaged county facilities; and,
WHEREAS, persons and property are, or may be, damaged unless further efforts
are taken to reduce the threat to life and property; and,
WHEREAS, there is an emergency which necessitates rapid repairs to meet the
emergency needs of the community;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Jefferson County
Commissioners hereby declare that a state of emergency exists.
The County Department of Public Works is authorized to enter into contracts and
incur obligations necessary to combat this emergency to protect the health and safety of
persons and property.
The County Department of Public Works is authorized to exercise these
emergency powers in the light ofthe exigencies of an emergency situation without regard
to time consuming procedures and formalities prescribed by law, with the exception of
mandatory constitutional requirements.
