Commissioners,
The Lease document posted for the subject meeting is dated August 15.
But numerous revisions were made to that document during your meeting on August 22.
It is difficult to provide meaningful comment on a proposal when the most current version of the document is not made available to the public.
At the risk of being redundant, I’ll repeat my earlier comment that paragraph 9.b. should be revised.
9. RENT.

b. Additional Rent.
In addition to the Base Rent, OlyCAP shall pay as Additional Rent any amount the County must pay from fees or taxes arising from OlyCAP’s activities.
The revision should make it clear that OlyCAP will be responsible for all fees (not taxes) that are or will be assessed on the leased property during the term of the lease, not just
those fees that might “arise from OlyCAP’s activities”.
One never knows what kinds of new fees will be imposed by some government entity over the next 42 years in addition to the existing fees.
