ROOT PROBLEM
The 31-million-dollar verdict in the Kobe Bryant Crash Photos case is emblematic of the root problem with most government social media policies and training in the public sector.
Many public agencies wrongly risk social media as a public relations issue. They are either unaware or choose to ignore recent U.S. Supreme Court and federal court rulings that classify
social media as a "high liability" human resource issue.
This misperception leads to the creation or purchase of social media policies and training programs that don't comply with the new higher federal standards. The fallout is a loss of
big legal fees, the public trust, careers, and employee exposure to personal liability that can wipe out their life savings.

SUMMARY OF FINDINGS
Inadequate Social Media Liability Training
* 97% of the in-house attorneys and other decisionmakers I contacted or worked with over the past 5 years said they were unaware of the new 1983 federal social media training and policy
standards.
* 100% of employees in my training programs were never notified they could be sued personally under 42 U.S.C. 1983.
* 100% of employees in my training were never notified that even if they had personal liability insurance, it would not cover their social media mistakes. Most social media harm is adjudicated
by courts as willful, not accidental; insurance policies exclude willful conduct from coverage.
* 100% of my course participants said they were given verbal warnings, not in-depth social media liability training from an outside social media attorney specialist.
* Despite claiming they received adequate social media liability training from their in-house attorney or conferences, the average score on my basic social media law competency pre-tes

Inadequate Social Media Policy Development
* Governments nationwide are losing millions of dollars in social media related cases because they are placing blind trust on defective model social media policies from reputable organizations.
Most of these policies are not written by an attorney who specializes in social media liability and the policy drafter is unaware of the new federal standards.
* Out of 200 social media policies I recently updated, not one policy complied with the new federal standards; without my changes the policy would have been ruled invalid in court. It
should be noted that most of these policies originated from reputable policy services and national associations.
* Busy in-house attorneys are not social media law experts and are unknowingly using defective model policies from reputable organizations that courts find unconstitutionally vague.
* Courts rule that a social media policy impacts an employee's fundamental constitutional and civil rights. Therefore, the policy must be reinforced with outside expert social media
liability training for all employees.
