HomeMy WebLinkAboutState of Washington Highway Commission • • cc.g..51,9.,' A G-<.:::.IENT HWY. s lIn3o r7 trot etion THIS AGREEMENT, made and entered into this day of , ,A74 196Z, by and between the State of Washington, Washington State Highway Commission, acting by and through the Director of Highways, hereinafter referred to as the "STATE" and the County of Jefferson, acting by and through the Board of County Commissioners and hereinafter referred to as the "COUNTY" WITNESSETH: WHEREAS, the State completed construction of State Route 104 from Quilcene- Center Valley Road to State Route 101 on July 18, 1968 and has transferred the state highway traffic thereto, and WHEREAS, said completion and transfer of traffic made existing State Route 104, hereinafter referred to as existing County Road No. 87, from the vicinity of Center situated in the SE4 of the SW4 of Section 3, Township 28 North, Range 1 West, W.M. , thence northwesterly to State Route 113 situated in the SW4 of the NE4, Section 19, Township 29 North, Range 1 West, W.M. , a total of 5.38 miles, as shown in red on the attached EXHIBIT "A" , unnecessary to the State Highway System. By the above reference, said EXHIBIT "A", shall be made a part of this agreement, and WHEREAS, the State certified the existing County Road No. 87 descr-bed above, in accordance with RCW 36.75.090, and WHEREAS, certain maintenance work is necessary on this said existing County Road No. 87 to place it in normal condition of maintenance, NOW THEREFORE, the parties hereto mutually agree as follows: I The County agrees to furnish all labor and equipment for the removal of danger trees and brushing on County Road No. 87, between the approximate limits as shown in red on EXHIBIT "A", for the lump sum amount of $2,500.00 -1- II The State agrees to pay the County the lump sum amount of $2,500.00 as specified in Article I above upon the County notifying the State, in writing, that the said work specified in Article I above has been completed. III It is provided and agreed that no liability shall attach to the State by reason of entering into this agreement except as expressly provided herein.
