THIS AGREEMENT is by and between HERSCHEL L. ATKINSON,
hereinafter referred to as "Atkinson" , and JEFFERSON COUNTY, acting
by and through their duly elected Board of County Commissioners,
hereinafter referred to as the "County" .
WHEREAS , certain salvagable materials are discarded at
the Jefferson County Landfill ; and
WHEREAS , the organization of county government does not
provide for the operation of a salvage business; and
WHEREAS , Atkinson has advised the Board of County
Commissioners that he has the experience and the equipment to operate
a successful salvage operation at the county landfill;
NOW, THEREFORE , it is agreed:
(1) Atkinson will have the right to salvage items of
personal property discarded by the public at the Jefferson County
Landfill located off Miller Road in Jefferson County.
(2) Atkinson shall actively work at the said salvage
business.
(3) In performing the salvage work, Atkinson shall provide
his own equipment, supplies and materials ; he shall establish his
own working hours ; and he shall proceed in accordance with his own
operating methods.
(4) Atkinson shall perform the salvage operation in such
a manner as to not interfere with the landfill operation and not
interfere with ingress and egress of the public . Storage of salvaged
items and materials shall be placed in a manner which will avoid
unsightly appearance and which will avoid interference with the land-
fill operation.
(5) Atkinson shall remove salvaged items and materials on
a regular basis.
(6) Atkinson shall compensate the County by paying to the
County forty percent (40%) of the gross sales from all items salvaged

from County property. Payments by Atkinson to the County shall be
made as convenient, but at least once each month.
(7) Atkinson shall keep a complete record of all sales of
salvaged items from County property and shall make those records
available to the County at its request.
(8) Either party may terminate this agreement, without
cause, by giving written notice to the last known address of the other
party two weeks prior to the termination date. Should Atkinson ' s
operation interfere with the landfill operation or with public ingress
and egress , the County may terminate this agreement immediately.
