HomeMy WebLinkAboutInterlocal Cooperation Agreement - Housing and Urban Development (HUD) (0002) 1 INTERLOCAL COOPERATION AGREEMENT THIS AGREEMENT is entered into this / p day of September , 1978 , by and between JEFFERSON COUNTY, WASHINGTON; THE CITY OF PORT TOWNSEND, WASHINGTON; CLALLAM COUNTY, WASHINGTON; and THE CITY OF PORT ANGELES , WASHINGTON. WHEREAS , the Department of Housing and Urban Development (HUD) has available funds for use in rehabilitation of moderate and low income housing; and WHEREAS , the application for such funds can be made jointly by cooperating counties and/or cities ; and WHEREAS , the parties hereto deem it advantageous to the citizens which they represent to present a joint application for the HUD funding; Now, Therefore IT IS AGREED: (1) This Agreement shall be effective on the date set out above and shall continue in effect until the purpose for the Agreement has been fulfilled (HUD funds have been received and administration of the rehabilitation projects completed) or until terminated, either as set out below in Paragraph (6) or by mutual agreement. (2) Jefferson County shall be the "Lead Agency" for all purposes related to the HUD Community Development Block Grant. In its capacity as Lead Agency, Jefferson County shall have authority to contract with other entities for services required in development of the final application for the said grant and for the administration of grant monies received. It is contemplated that Jefferson County will contract with the Clallam-Jefferson County Community Action Council for preparation of the final application for the housing rehabilitation grant, and that additional administrative services may be contracted with that agency. Subsequent to the final approval -1- VOL 4 � U� 01812 4 by HUD of the $500 , 000. 00 grant request, the administrative expenses incurred by Jefferson County through the Clallam-Jefferson County Community Action Council shall not exceed $40, 000 . 00 unless addi- tional administrative work is authorized in writing by the parties hereto. For work performed and expenses incurred for preparation of the Final Application the Clallam-Jefferson County Community Action Council shall be reimbursed from the grant the amount of (3) The purpose of this Agreement is to obtain from HUD through its Community Development Block Grant, or from other sources, funds for rehabilitation of housing units within the boun- daries of the counties and cities which are parties hereto and to administer distribution of those funds to families of moderate and low income for rehabilitation of their housing units. (4) All financing for the project shall be provided by HUD, and no local matching funds by the parties hereto are required. If for any reason the Final Application is not funded by HUD, then the costs of preparing the Final Application shall be borne by the Clallam-Jefferson County Community Action Council. (5) The number of housing units assisted in each partici- pating city and county will be proportional to that area' s percentage share of the total number of substandard housing units, according to data from the 1970 census and from HUD. Assistance from grant monies may be expended on a grant,loan or deferred loan basis. Re- payment of all loans from this program shall be returned to the county or city in which the assisted unit is located. These funds shall be used for additional housing rehabilitation or other com- munity redevelopment under the direction of the legislative authority or an agency of the county or city in which the funds were first loaned. -2- oL 4 F��� fl 1813 4 ' (6) Should any party hereto wish to withdraw from participation in this Agreement , that party shall provide ninety (90) days written notice to each other party, and shall reimburse the Lead Agency for any costs and/or expenses related to or occasioned by the party ' s withdrawal. Withdrawal shall be effective ninety (90) days following date of notification and payment of the costs and expenses. (7) It is not contemplated that any property or assets will be acquired by Jefferson County, as Lead Agency, or by any other party hereto, except as set out above in Paragraph (5) ; however, should any property and/or assets , except as provided in Paragraph (5) , be acquired and held on the date this Agreement is terminated or on the date any party should withdraw, each party shall receive an equal share of such property and/or assets . Mercer, Chairman JEFFERSON COUNTY Board of County Commissioners BOARD CF COMMISSICNERS Jefferson County Courthouse Port Townsend, WA 98368 RE: HUD Housing Rehabilitation Grant Dear Mr. Mercer: Under date of August 3 you were provided a copy of my draft of an Interlocal Cooperation Agreement for the parties applying jointly for the above referenced HUD housing rehabilitation grant. The revised draft of that agreement which is attached, contains a number of changes which you will want to note. The first change appears in Paragraph (2) where a maximum amount is established for administration of the grant, and also a provision for setting the amount of expense incurred by the Community Action Council for preparation of the Final Application. A second major change occurs in Paragraph (4) . In the initial draft the costs and expenses not paid by HUD were to be shared equally by the parties to the contract. The agreement has been redrafted in its present language because, as I understand it, representations were made to the Clallam County Board of Commissioners stating that there would be no financial obligation on their part. They have therefore insisted that the agreement be modified to place the burden of all costs on the Community Action Council if payment is not received from HUD. A third change occurs in Paragraph (5) where the method of apportioning the grant monies is set out and a procedure is outlined whereby grant monies which have been loaned and returned to the various parties can be used for further rehabilitation.
