HomeMy WebLinkAboutPuget Sound Council of Garvernments July 12, 1978 • _ p 5c O Grand Central on the Park•216 First Avenue South•Seattle, Wash. 98104 • 206/464-7090 Puget Sound Council of Governments AGREEMENT The undersigned parties , representing the Puget Sound Health Systems Agency (PSHSA) , the Puget Sound Council of Governments , the North- west Regional Council , and the Counties of Clallam and Jefferson, do hereby agree to the following changes within the PSHSA' s structural organization and operational procedures , which changes are to be detailed by a task force representing the PSHSA and local governments beginning in Fall 1978 . Structural Change #1 Local governments may fill up to 25% of the seats on the 71-member HSA Board by direct appointments . The HSA Board reserves the right to require that local government appointees fit into specific con- sumer/provider or other representational categories when this is necessary in a given year to meet representation requirements of the law. (Section 1512(b) (3) (C) (iii) (I) of P .L. 93-641 provides that "the membership shall include (either through consumer or provider members) public elected officials and other representatives of governmental authorities in the agency' s health service area . . . . " . ) All government appointees will be subject to the same attendance and replacement bylaws as are all other board members . Structural Change #2 Local governments may fill up to 25% of the seats on the 25-member Executive Committee by direct appointments . The HSA Board reserves the right to require that local government appointees fit into specific consumer/provider or other representational categories when this is necessary in a given year to meet representation re- quirements of the law. All government appointees will be subject to the same attendance and replacement bylaws as are all other board members . Structural Change #3 Local governments may fill 25% of seats on the subarea council boards of directors and executive committees . (Section 1512(b) (3) (C) (iii) (I) of P .L. 93-641 provides that "the membership shall include (either through consumer or provider members) public elected officials and other representatives of governmental authorities in the agency' s health service area . . . . " . ) (Paragraph (c) of that Section provides that "the composition of a subarea advisory council shall conform to the requirements of subsection (b) (3) (C) " . ) 25% of the seats would be guaranteed, but a particular local government could elect to fill less than 25%. VOL 4 iff 01594 Page 3 Structural Change #4 HSA and SAC nominating committees will be composed of an even number of members , one-half to be elected as in current procedures and one-half to be appointed by local governments . The committee will elect its own chairman from within the committee ' s membership as currently provided in the HSA' s bylaws . The government entities to be granted appointment privileges will be identified in the bylaws of the HSA and each subarea council and may be different in each subarea. A majority of those appointed to nominating committees by local government will be persons who have had at least one year ' s active involvement with the HSA or respective subarea council . The HSA Board reserves the right to require that local government appointees fit specific consumer/provider categories . All govern- ment appointees will be subject to the same attendance and replace- ment bylaws as are all other members of the respective nominating committees . Structural Change #5 Local elected officials in general purpose governments will receive invitations to meetings of their subarea general councils . Structural Change #6 A 30-member HSA Board, will be phased in over a two-year period, with the Executive Committee to be eliminated. Local elected officials may appoint 25% of the 30-member board. No subarea council will have fewer than two seats on the 30-member board. HSA Board reserves the right to require that local government appointees to a 30-member board fit into specific representational categories . Operating Procedure Change #1 In order to promote consistency with other regional and local plans , Memoranda of Understanding will be developed between the HSA, sub- area councils and appropriate local government(s) , with each = memorandum containing a mechanism for the resolution of differences between governmental , HSA, and subarea plans . Such mechanisms must include the possibility of amending either or both parties ' plans in order to bring them into conformity. Operating Procedure Change #2 Local governments will be offered the opportunity to review and comment upon Certificate of Need applications within the HSA' s allotted 60-day review period, making their recommendations to the subarea bodies responsible for certificate of need reviews . Operating Procedure Change #3 Local governments and the HSA will work toward a coordinate A-95/ HSA review of federal grant applications and will develop a plan for joint financing of the review process . 3 91595 • - Y Page 3 Operating Procedure Change #4 Planning for areas such as housing , transportation, land use, economic development, sewers and water, etc. has impact on health just as health planning impacts on these areas . Subarea councils will have a staff or volunteer representative sitting with sub- regional COG councils deliberating on these areas to assure that I the impact of health is considered, as the impact of these other planning subject areas is to be considered in health planning . Hudson, President Councilman, City of Tacoma SUBJECT : Agreement between HSA and Local Governments Enclosed for your signature is the original copy of the agreement between the Puget Sound HSA and local govern- ments . The HSA and the PSCOG Executive Board signed the document on July 27th. The PSCOG is very pleased with the outcome of the several months of negotiation and deliberation. We are looking forward to participating in the implementation of the agreement and will be contacting you in the near future with respect to the establishment of a task force to carry out that responsibility. If I may, I would ask that each of you forward this docu- ment along to the next signator so that all signatures may be obtained as quickly as possible . Envelopes are enclosed for your convenience . The fully signed agreement should be returned to PSCOG where copies will be made and dis- tributed to each of you. Hudson, President Councilman, City of Tacoma SUBJECT : HSA/Local Government Agreement Enclosed for your information and file is a copy of the fully signed agreement between the Puget Sound Health Systems Agency and local governments in the ten-county region. I consider this agreement a major step toward strengthening cooperation between the health systems structure and local governments and look forward to its implementation. The PSCOG will take the lead in setting up the local government portion of a task force assigned to detail the agreement and recommend measures for implementation. Please let me know of any specific thoughts you may have in this regard.
