Urge Congress to Advance Legislation Protecting Federal Health Benefits for Pre-Trial Detainees
Contact your members of Congress and ask them to include policy that would protect the constitutional rights of pre-trial individuals in an end-of-year legislative package
The Medicaid Inmate Exclusion Policy (MIEP) strips federal health benefits from individuals admitted to jail before they are convicted of a crime. This policy violates an individual’s
constitutional rights and fundamental presumption of innocence, strains our local judicial, law enforcement, public safety and human services systems, and results in higher rates of
recidivism and poorer health outcomes in our communities. This policy contributes to the over-incarceration of individuals suffering from mental and behavioral health crises, making
jails the largest behavioral health providers in the nation.
As Congress considers an end-of-year package, the National Association of Counties (NACo) urges you to contact your U.S. House and Senate members and ask them to support efforts that
would address MIEP.
