The mapped stream is a non-fish habitat with 20% grade. The prescriptive buffer for this type of stream is 75 feet plus a 5-foot building setback. The proposed buffer reduction is in an existing developed area on the south side of the mapped stream. This section of the stream runs through a culvert. The proposed buffer increase is also on the south side of the mapped stream, to the east of the proposed buffer reduction. The area of the proposed increase is sloped and vegetated. The size and location of streams and buffers were supported by Jefferson County Geographic Information System (GIS) mapping. A site visit was conducted by H. Smith, Assistant Planner, on September 29, 2022. David Otos was present. The site visit confirmed the location of the stream, culvert, and buffer areas. It also confirmed that the buffer reduction and increase areas were comparably sized and accurately represented by the Meehan-Roulst report. This is a satisfactory way to buffer the stream. DCD concurs with the buffer averaging plan presented in the Meehan-Roulst report. Future development would be subject to the following conditions: 1. Site Development Review: Per Ordinance No.09-1033-22, a Site Development Review would be a prerequisite for any new development. 2. Site Plan: Development applications for this property must include a site plan showing the averaged buffers and proposed locations of temporary silt fences or other stormwater protection measures to protect the stream during construction. 3. Stormwater Review: No ground disturbance would be allowed until DCD reviews the location of the silt fence or other stormwater protection measures. 4. Native Vegetation: Additional plantings in the buffer, such as those proposed in the report, must be scientifically named native plants. Invasive vegetation may be removed.
