HomeMy WebLinkAboutRESOLUTION re Unclaimed Warrants Consent Agenda Treasurer JEFFERSON COUNTY BOARD OF COUNTY COMMISSIONERS CONSENT AGENDA REQUEST TO: Jefferson County Board of Commissioners THROUGH: Mark McCauley, County Administrator FROM: Stacie Prada, Treasurer DATE: October 17, 2022 SUBJECT: Cancelation of unclaimed warrants exceeding one year STATEMENT OF ISSUE: The Treasurer's office requests approval of a resolution canceling a total of 18 outstanding claims warrants that exceed two years from date of issuance. There are no payroll warrants exceeding one year from date of issuance. ANALYSIS: Warrants of any municipal corporation not presented within one year of issue shall be canceled by the passage of a resolution of the governing body (RCW 36.22.100). RCE 63.29.150 lists one year at the abandonment period for wages and payroll checks, and RCW 63.29.130 lists funds held by public agencies as abandoned at two years. To comply with both, claims warrants included exceed two years and meet the period of abandonment for both statutes. FISCAL IMPACT: The funds are credited to the issuing fund. WHEREAS, pursuant to RCW 36.22.100, registered or interest bearing County warrants not presented within one year of the date of their call and other County warrants not presented within one year of the date of their issue shall be canceled by the legislative authority of the County; and WHEREAS, pursuant to RCW 63.29.130, intangible property held by public agencies that remains unclaimed by the owner for more than two years after becoming payable or distributable is presumed abandoned; and WHEREAS, pursuant to RCW 63.29.150, unpaid wages, including wages represented by unpresented payroll checks, owing in the ordinary course of the holder's business which remain unclaimed by the owner for more than one year after becoming payable are presumed abandoned; and WHEREAS, the warrants included in the attached list "Exhibit A" includes uncashed warrants abandoned per RCW 63.29.130 and 63.29.150; NOW, THEREFORE, BE IT RESOLVED, by the Jefferson County Board of County Commissioners, that the warrants specified in the attached list"Exhibit A" be canceled in compliance with the above noted RCW; and, BE IT FURTHER RESOLVED, that the County Auditor and Treasurer shall cancel all record of such warrants so as to leave the funds as if such warrant had never been drawn.
