The following information is needed to continue review of your project. In our January 13, 2022 letter, we requested that BDN provide responses by the items listed in the letter. However, the responses sent by BDN on April 11, 2022 did not follow our suggestion. In addition, BDN submitted a revised eelgrass survey on July 13, 2022, which we needed to review. This letter requests additional information for the BDN application and is based on a review DCD has completed of documents submitted on April 11, 2022 and July 13, 2022. Please provide a response to the following items. 1. In the January 13, 2022 letter, DCD requested information about upland parcel 970200001, which is owned by James Smersh and is located on the north side of Shine Road. The applicant was asked to either complete the BLA process with parcel 970200002 by recording a conveyance deed at the Jefferson County Auditor's Office or submit a road approach application to Jefferson County Public Works and submit a revised stormwater calculation worksheet to DCD. In response, BDN stated in its April 11, 2022 response that for parcel 970200001 there is an easement reflected in Auditor document number 378280. But Auditor document 378280 appears to refer to a different parcel number, parcel 821343005. Please clarify how parcel 970200001 will be accessed. 2. Also in the January 13, 2022 letter, DCD asked if the boat moored at parcel 821334011, which is owned by BDN, LLC would be used for the current proposal. DCD reviewed the materials submitted by BDN, but was unable to find if use of the boat and this parcel were part of the geoduck proposal on the Smersh tidelands. Clarify if this parcel is part of the proposal currently under review. 3. Based on the 2022 eelgrass delineation, as shown in the BDN Eelgrass Bed Delineation — 2016 Final Report (prepared by Confluence Environmental Company, dated July 2022), the extent of native eelgrass is shown farther northeast than in the previous two delineations in places. The area to be planted with geoduck seed (i.e., the area outside the 16-foot eelgrass buffer), under the most recent delineation, would be expected to be less than the 5.15 acres stated in earlier submittals. Clarify the total acreage to be planted with reference to the updated eelgrass survey. 4. The document entitled Brad Nelson Message to the Squamish Bay Community — January, 2022 states that he is "developing a visually unobtrusive and environmentally sound low barrier system to prevent tubes moving into the park." Provide additional information about this system so we can determine if this system needs to be incorporated in to the permit. 5. Commercial development/use requires screening from adjacent residential uses. This requirement applies to the two upland parcels (Smersh parcel on the north side of Shine Road and BDN LLC parcel accessed from Shine Road). The proposal must meet the 'Screen-C' landscaping (or see -through screening) requirements in JCC 18.30.130(3)(c). In re -reviewing materials to find response to each of the items in our January 13, 2022 letter, DCD noticed that aerial photographs indicate that portions of these two parcels may not meet this requirement. Please submit photographs of each side of these parcels. For any portions of these two parcels that do meet the 'Screen-C' requirements, submit a landscaping plan. Please submit the above information to the Department of Community Development within 90 days of the date of this letter which would be 1/11/2023.
