Usually a contractor license is required. Also,the bond amount in this case is low so the bond fee may not be enough for a bonding company to bother with. Another line of reasoning: Since the Douglas's are doing this improvement voluntarily(it's not caused by a new development requiring a building permit) we could waive the bond entirely and hope all goes well or have the shoreline permit state they will replant if the plantings fail. The critical areas code allows for general exemptions(see18.22.070 #4 and 21 below)or provisions of the CASP to be waived (see 18.22.550 below): 18.22.070 General exemptions.a ARE The following activities in critical areas or their buffers are exempt from the requirements of this chapter: 1 (1)Agricultural activities when undertaken pursuant to best management practices to minimize impacts to critical areas and consistent with JCC 18.20.030. (2) Forest practices regulated and conducted in accordance with the provisions of Chapter 76.09 RCW and forest practice regulations,WAC Title 222, and which are exempt from Jefferson County jurisdiction. (3) Maintenance or reconstruction of existing public or private roads, paths, bicycle ways,trails, bridges, and associated storm drainage facilities when undertaken pursuant to best management practices to minimize impacts to critical areas and to immediately restore any disturbed critical area or its buffer; provided, that reconstruction does not involve expansion of facilities. (4)Maintenance and repair of existing drainage facilities or systems, including, but not limited to,ditches, culverts,catch basins,and outfalls when undertaken pursuant to best management practices to minimize impacts to critical areas and immediately to restore any disturbed critical area or its buffer. (5) Utility activities,when undertaken pursuant to best management practices to minimize impacts to critical areas and immediately to restore any disturbed critical area or its buffer: (a) Normal and routine maintenance or repair of existing utility facilities or rights-of-way. (b) Installation, construction, relocation and replacement, operation, repair, or alteration of all utility lines, equipment, or appurtenances, not including substations, in improved road rights-of-way. (6) Reconstruction, remodeling, or maintenance of existing structures. This exemption shall not apply to reconstruction which is proposed as a result of structural damage associated with a geologically hazardous area and does not allow further intrusion into a wetland,fish and wildlife habitat conservation area and/or their buffers. (7) Site investigative work. Site investigative work necessary for land use application submittals, including but not limited to surveys, soil logs, and percolation tests involving no fill or use of heavy equipment in a wetland, or a fish and wildlife habitat conservation area or their buffers; provided, that disturbed critical areas and their buffers are immediately restored and best management practices are implemented and excavation for soil logs or percolation tests are filled. (8) Emergency action.Action that is taken which is necessary to resolve or prevent imminent threat or danger to public health or safety, or to public or private property, or serious environmental degradation. If the nature of the emergency is such that it is not possible to first seek review,the department, as well as any federal or state agencies with jurisdiction (e.g.,the U.S.Army Corps of Engineers), must be notified of the action within 30 days of the initiation of the emergency work. 2 (9)Artificial wetlands and artificial ponds. (10) Flood control. Operation, maintenance and repair of dikes, ditches, reservoirs, and other structures and facilities which were created or developed as part of normal flood control activities, except that this exemption does not extend to the permanent draining or permanent alteration of any regulated wetland. (11) Irrigation. Operation, maintenance and repair of ditches, reservoirs, ponds and other structures and facilities. (12) Recreational uses, swimming, boating and fishing. Maintenance and repair of docks, piers, boat launches and floats in lakes(provided that the proposed action complies with the requirements of the Shoreline Management Act), in deep water habitats one acre or greater in size when such activities are for recreational purposes and do not involve alteration of or construction through, over or in a regulated wetland. Other outdoor activities, including hunting and fishing (pursuant to state law), bird watching, hiking, bicycling. (13) Existing residential landscaping. Planting, irrigating,fertilizing, spraying, mowing and pruning and maintenance and repair of structures when such activities are part of existing normal residential landscaping activities and no building permit is required. This exemption does not allow further intrusion into a wetland, fish and wildlife habitat conservation area, geologically hazardous area or their buffers. (14)All wetlands wherein wetland conditions are being maintained only because of human-induced water, even if it can be determined that the wetland conditions would no longer exist if the activity(for example, irrigation or pumping water)were to be terminated. (15) Removal or destruction of noxious weeds listed in Chapter 16-750 WAC is the responsibility of the landowner; provided,that the following conditions are met: (a)The removal or control of noxious weeds shall follow guidelines issued by the Jefferson County noxious weed control board.The Jefferson County noxious weed control board shall coordinate with the department of planning and community development for the control of noxious weeds in wetlands. (b)All herbicide applications in aquatic environments shall conform to the rules of the Department of Ecology, Department of Agriculture and Department of Natural Resources, pursuant to Chapters 173- 201, 16-228, and 222-38 WAC. (16)The harvesting of wild crops in a manner that is not injurious to natural reproduction of such crops and provided the harvesting does not require tilling soil, planting crops, or changing existing topography,water conditions, or water sources and provided these activities do not have any adverse impacts on protection of the critical area or its buffer. 3 (17)The enhancement of a buffer by planting indigenous vegetation. (18)The construction of unpaved trails when located in the buffer areas and elevated when located in wetlands,which are not intended for motorized use, and which are no wider than five feet, unless additional width is necessary for safety along a precipice, steep hillside, or other hazardous area. (19) Installation of navigation aids and boundary markers. (20) Drilling or digging and maintenance of wells; provided,that impacts to critical areas and their buffers are minimized and disturbed areas are immediately restored. (21)The administrator may determine that an activity is closely allied or similar to any activity in this list. If such an activity does not impact the functions and values of any critical area or its buffers,it may also be determined to be exempt.[Ord. 3-08§ 1] 18.22.550 Waiver.P. _SHARE _.. .' The administrator may waive portions of a critical area stewardship plan (CASP) if, in his/her opinion, critical area functions and values will not be adversely affected by a proposed activity.An approved CASP must be recorded on the property deed (recorded with the Jefferson County auditor) and must remain in effect unless replaced by a new or updated CASP approved by the county. Frankly,$6,079 was a shock as was learning we even needed a bond. I understand the rationale for a performance bond and that the money will be returned in 5 years. However,the fact remains that we don't have$6K to put up for a bond at this time. Is there any way to reduce the amount since all our efforts/resources directly benefit the county? We are at^ $34,000 and counting for our contribution to restore county property. This amount doesn't include another MSA bill coming plus now more money to the county for permitting and then of course eventual work on the beach. Besides the bond,adding to my concern is my experience that the slightest delay has a domino effect on other agencies with the potential result we again miss the window for digging on the beach. We appreciate your consideration. I hope you consider the enormous hours/efforts I have put in doing what is right. I also hope you take into account your experience of me- I keep my word and am dedicated to beach restoration. The full amount of the performance bond can be refunded at the end of the 5-year monitoring period, assuming all performance measures have been met. Once the performance bond has been paid, I can issue the shoreline permit. Please be aware that you pre-paid for 7 hours of review time for the shoreline application and I have spent more than 7 hours reviewing the application. I have not yet calculated the total hours worked on the shoreline permit, but that fee will also need to be paid prior to issuing that permit. Once the shoreline permit is issued,you will have all your county permits. I would appreciate receiving a copy of what they submit. I unfortunately found out the PN did not go to the neighbors. So I sent them the PN and heard back from Mr. G. We exchanged a number of emails. He did not have any substantial project specific comments on the proposed project. I am proceeding to finalize my review of their application. I hope to finish my review by the end of the month at which time I will then forward the documents to my supervisor who completes the final review and makes the final decision. Also, before we can make a final decision we need to have a 401 WQC decision from Ecology. I will double check, but I believe I do not have this yet. I have not yet reviewed the submittal but want to check in with you on the following: • Is the July 25, 2014 BE intended to address fish and wildlife habitat conservation area requirements in Chapter 18.22 JCC(or is it limited to T&E species for the federal ESA)? • I do not see a date on the re-submitted JARPA. Was it revised based on the site visit with agencies earlier this year? Justin: I will need the following, which should be based on proposal revisions that were agreed upon earlier this year when we met onsite: • The BE submitted by MSA shows engineered drawings with a revision date of July 18, 2014. Are these the most recent drawings? If so, please send me three (3) copies of the site plan and the detailed sheets with original stamp and signature. • Provide information about the number of cubic yards of materials/sediments that: (1) will be scalped from the high points; (2) will be placed in the intertidal zone to reconfigure the channel; and (3)will need to be moved to an off-site location. Identify the disposal site location for any materials that will be transported offsite. Make sure the method of conducting the channel revision and the limits of the work areas are specified. • As I recall, NTI prepared the original Environmental Checklist. Revise, as appropriate,and re-submit the Environmental Checklist based on proposal changes made during the on-site meeting earlier this year with agencies. Possibly, MSA can assist you with the revisions since the description of the project in the Environmental Checklist needs to be consistent with the BE and the JARPA. DCD needs to review the proposal against drawings that are to scale and have the engineers stamp and signature. Please submit three copies of the site plan and the detail drawings(that also identify how much materials will be scalped, how much will be placed in the intertidal area, and how much (if any)will be removed from the site). Trenching of county beach in December 2008 has eroded the sand spit and beach habitat as shown in these 5 photos. This is a man-made problem which requires a man-made solution. We been working with the Jefferson Department of Community Development staff on beach restoration for the last 18 months. Our experience is the county is committed to doing what is right. What has been an eye-opener is the length of the process and the negative impact of staff cutbacks. In fact, in January Community Development staff hours were decreased from 40 to 32 hours a week. This decrease in staffing means not all violations are addressed in a timely manner or followed up on at all. It's easy to blame"the county"without realizing the difficulty of their tasks with reduced staffing. We worry this will encourage even more flagrant disregard for the permitting process. There are three property owners along Quilcene Bay who have been involved with DCD about stream dredging: 1. Robert and Janet Palmer—have a stream on their property(along with Gusoskys) and DCD issued a permit for stream dredging in October 2011; these property owners are currently in litigation with the county for sediments entering the portion of the stream on their property. 2. John and Muriel Gusoskey—have stream on their property(along with Palmers)and they never came in for permitting after an emergency Hydraulic Project Approval (HPA) was issued by Washington Department of Fish and Wildlife(WDFW) in December 2008. 3. Reimer and Kathleen Douglas—recently had a pre-application meeting with DCD to restore a portion of the stream dredging conducted in 2008 that that extends into Quilcene Bay—they want to restore the bay to previously-existing conditions, which involves filling in the excavated channel. Violation Issue: Prior to dredging the stream in the winter of 2008/2009,John Gusosky contacted DCD about permitting for stream dredging. He was told he needed a permit. He was also told by DCD that if he obtained an emergency HPA from WDFW, he would need to come in for full shoreline permitting. He has never applied for'after-the-fact' county permitting. Current Issue: Kathleen Douglas has applied for a pre-app, which was held June 7, 2012, to restore the portion of Quilcene Bay to conditions prior to the 2008/2009 dredging. Some (but not all) concerns to discuss on Monday: 1. DCD wants to have John Gusoskey come in for permitting for 2008/2009 dredging. This stream also meanders onto property owned by the Palmers. 2. It appears that WDFW issued an HPA in 2008 to John Gusoskey that allowed him to dredge beyond his property boundaries. 3. Jefferson County owns one of the parcels that was dredged (County owns intertidal land); therefore,the County needs to be an applicant on any permitting submittal. 4. Options available to the County in JCC 18.50(Enforcement) if Gusoskey does not come in for an 'after-the-fact' permit. Attached: 1. Chronology of events for these three parcels. 2. The proposal was to dredge an unnamed stream to Quilcene Bay. Provision 4 of the HPA says that the work was to be accomplished based on plans and specifications approved by WDFW. Jefferson County DCD is hoping to get copies of those plans. John Gusoskey never came in for'after-the-fact' shoreline permitting and it appears that the dredging may have extended beyond that approved by WDFW onto intertidal land owned by Jefferson County. Also, another property owner is looking into getting a permit to put the intertidal portion of the stream back to the condition prior to the 2008 HPA. Because of the recent interest in another permit by a different property owner, DCD is hoping to get copies of approved plans and specifications at your earliest convenience. This would include your work estimate. The fair market value definition in Jefferson County Code 18.25.040 (6)is: "Fair market value," for a development, is the open market bid price for conducting the work, using the equipment and facilities, and purchase of the goods, services and materials necessary to accomplish the development. This would normally equate to the cost of hiring a contractor to undertake the development from start to finish, including the cost of labor, materials, equipment and facility usage, transportation and contractor overhead and profit. The following Critical Areas are mapped on the parcel; stream type "F" fish bearing stream, FEMA Hazard, Coastal Salt Water Seawater Intrusion Protection Zone (SPIZ), Susc Aquifer Recharge Area (SUSC), Shoreline Designation URBAN. The Fish and Wildlife Habitat Conservation Area (FWHCA): The stream is a type "F" fish bearing . A setback of 150 feet from the ordinary high water mark (OHWM). I have attached Jefferson County Code (JCC) 18.22 table 18.22.270(1) identifies the buffer requirements. FEMA Flood Hazard area: When locating the structure with the Flood Hazard area a Flood elevation certificate is required. I have attached the JC GIS mapping identifying the flood hazard area. This is a guideline to the location of the flood hazard area. Wetlands: A wetland delineation is required when a structure is not located outside of the maximum requirements in table JCC 18.22.330(2). Shoreline Jurisdiction is 200 feet from ordinary high water mark. When located outside of the Shoreline Master Program (SMP) it is considered Growth Management Act and is reviewed in the JCC 18.22. I have outlined above in regards to streams and wetlands. Jefferson County is the process of updating the SMP. There is no exact time when the the updated shoreline master program (SMP) will be adopted. Department of Ecology is requiring the SMP be updated by 2011. Please give me a call and we can discuss this in further detail. 1 Setbacks: Road Setback in a residential zone from a minor collector road is measured 20 feet from the edge of the road right -of-way. East Quilcene Road is a minor collector road. Property line setbacks when abutting residential property is 5 feet. Shoreline setback is located in JCC 18.25.410(4)(j). Minimum setback is 30 feet from the ordinary high water mark when there is no bank or when the bank is less than 10 feet high. When the is a bank greater than 10 feet height, the setback is 30 feet measured from the top of the bank or 1 foot back from the top of the bank for each foot of bank height whichever is greater. Shoreline setbacks do not exceed 100 feet unless there are severe landslide hazard concerns. To obtain a building permit for a single family residence, the applicant must show proof of potable water, have applied for or approved septic design or sewer connection, and apply for or have an address and road approach permit. Thanks, Larry Sherman The following is my note to Ms. Schirato: "I requested and received a permit to reinforce my rip rap wall at 183 Wampum Point Road in Quilcene about 6 months ago.Thank you for your help with this.The reason I am writing is that I became aware of a project 3 lots down from mine (I am at 183 Wampum Point Road,just off of Lindsay Hill Road and East Quilcene Road intersection. My lot is on the water and of course I realize this engenders special attention to the marine habitat. The project 3 lots down from mine involves at rather large excavation done with some heavy equipment in which a small stream (which I have been told is salmon spawning habitat) has been diverted from its natural course running more or less directly west into Quilcene bay at the sand spit there.An 8 or 10 foot wide ditch has been dug and now makes a right angle in front of the Gusoskey's house and runs across the front of their small rip rap wall into the bay behind the sandy projection of beach.The diversion is quite a big change and actually passes onto the property of the Gusoskey's neighbors to the north (Kathleen and Reimer Douglas).The Douglas's were not aware of this operation and I am surprised that a construction which diverts a stream onto adjoining property would be allowed without some notification of those involved. Can you inform me of whether this was permitted by your agency and why notification of those in near proximity who would be affected was not made?Thank you for looking into this matter.
