GOVERNMENT AFFAIRS
Update on Sackett v. Environmental Protection Agency – Sarah Gimont
* On October 3, the U.S. Supreme Court began hearing oral arguments in Sackett v. EPA, a case that will carry significant implications for federal jurisdiction over waters and wetlands.
In the case, the Court will decide the proper test for determining when wetlands are protected under the term “Waters of the United States” (WOTUS).
* The EPA is currently in the process of writing a new definition of WOTUS and recently sent its new rule to the Office of Management and Budget for interagency review, signaling its
intent to move forward with its interpretation and apply this rule in the context of the Supreme Court’s final decision.
Update on the Local Assistance and Tribal Consistency Fund and PILT- Jonathan Shiffield
* On September 29, Treasury made available the first tranche of two tranches of $750 million for Local Assistance and Tribal Consistency Fund (LATCF) payments to 2,086 “eligible revenue
sharing counties”. These funds were made available under ARPA. NACo worked diligently with our members to ensure Treasury understood these funds were originally intended by Congress
to go to public lands counties. Treasury distributed the funds to PILT and Refuge Revenue Sharing recipient counties, which is a significant win for public lands counties.
* Last month, over 30 county officials came to DC to lobby for full PILT funding in FY 2023 and for a long-term funding solution for public lands counties. Congress passed a short-term
continuing resolution to keep the government open through December 16 while congressional leaders and the White House continue to negotiate a final FY 2023 appropriations package, which
will determine PILT funding for next year.
