5. DCD Staff and Director Updates (5 minutes)
Deputy Director Peters provided an update on the results of the Legal Lot of Record (LLOR) legislative
process. In summary, the Board of County Commissioners adopted an ordinance on 10/3/2022. The
principal change from the Planning Commission recommendation was to place the Site Development
Review (SDR) as the principal process, with Legal Lot of Record Determination being integrated into
SDR, as required. Lots properly platted after 8/11/1969 are now presumed to be LLOR. Recording
positive LLOR determinations is now optional, not required.
Associate Planner Peterson provided an update on the Port Hadlock Wastewater Facility Project and
answered questions.
Part-time, clerk hire position for Planning Commission Clerk posted today. Commissioner Alen arranged
for publication with the Jefferson County Chamber of Commerce. (Thank you, Arlene!) It was suggested
that the notice be published in the Peninsula Daily News, as well as The Leader.
Mr. Peterson briefed the Planning Commission on a housing conference that he attended recently. He
described speaking with State Department of Commerce staff and other participants about housing issues
in rural communities.

8. Deliberation: Findings of Fact and Recommendations for Mineral Resource Land Overlay
Proposal, Miles Sand & Gravel, MLA21-00019
Associate Planner Peterson briefed the Planning Commission on the proposal. The Planning Commissions
discussed findings of fact pursuant to Comprehensive Plan amendment requirements per JCC 18.40.050 &
.080.
Coker motion to approve findings of fact; Richert second; 9 yes, 0 no, 0 abstain.
9. Planning Commission Retreat Summary: Discussion regarding Meeting Frequency, Content, and
Work Plan
Mr. Peterson shared summary notes from the retreat and posed the question about if and how Planning
Commissioners may want to adjust meetings in 2023. Following discussion, Chair Hull suggested that the
first of the two monthly meetings be the standard, full Planning Commission meeting. The second meeting
of the month would be optional for the full Planning Commission, if needed, or would otherwise be
canceled outright or repurposed for subcommittee meetings.
10. Bylaws Update: Review and Approval of Proposed Amendments
Commissioner Koan described the latest version of the proposed bylaws. Commissioner Smith moved to
approve bylaws, as proposed. Seconded by Commissioner Coker. During discussion, Commissioner
Sircely moved to proposed an addition. The motion to amend was seconded. The motion was amended to
include the addition as a preamble. Five (6) commissioners voted yes with three (3) abstentions. Motion to
approve amendment. Three (3) yes, three (3) no, and two (2) abstain. Motion fails.
Vote on original motion by Koan to approve proposed bylaws. Six (6) yes, one (1) no, and one (1) abstain.
