18.25.570 Statement of Exemptions
(1)The administrator is hereby authorized to grant or deny requests for statements of exemption from the shoreline
substantial development permit requirement for uses and developments within shorelines that are specifically listed
above. Such statements shall be applied for on forms provided by the administrator. The statement shall be in writing
and shall indicate the specific exemption of this program that is being applied to the development, and shall provide a
summary of the administrator’s analysis of the consistency of the project with this program and the Act. As appropriate,
such statements of exemptions shall contain conditions and/or mitigating measures of approval to achieve consistency
and compliance with the provisions of this program and Act. A denial of an exemption shall be in writing and shall
identify the reason(s) for the denial. The administrator’s actions on the issuance of a statement of exemption or a denial
are subject to appeal pursuant to the appeal provisions in Article X of this chapter.

Clarence Selvog and Barbara Petzoldt applied for a geotechnical report waiver during the course
of a Buildng Permit (BLD2020-00647) and Septic permit (SEP2021-00018) application. They
plan to construct a modular home and septic system upgrade. Their property is mapped as a
seismic area. I have reviewed the waiver request submitted by Clarence Selvog and Barbara
Petzoldt, available map and data, and completed the attached geohazard checklist. They will
implement applicable best management practices during construction. The building area has a
slope of about 4% and the parcel has an overall slope of 4%. Based on our available data, the
building site, proposed development, and analysis from the geohazard checklist I find that the
standards for a geotechnical report waiver, under Jefferson County Code 18.22.910, have been
satisfied.

INTRODUCTION
Ecological Land Services, Inc. (ELS) has been contracted by Bing Selvog to complete a habitat
management plan (HMP) for the proposed single-family home on property at 60 Pinto Lane,
Jefferson County Tax Parcel Nos. 966900076 and 966900077, in Brinnon, Washington. This
property is in a portion of Section 34, Township 26 North, Range 2 West of the Willamette Meridian
(Figure 1).
STUDY AREA DESCRIPTION
These existing platted lots are on the southeast side of Pinto Lane within the residential neighborhood
of Lazy C Ranch on the west end of Brinnon (Figure 2). Both lots are currently developed with a
garage/shop on the eastern lot (077) and an above-ground septic system on the western lot (076)
(Photoplate 3). The remainder of the lots are composed of open maintained grounds with a line of
conifer trees along the east property line, a group of large western red cedar trees at the southwest
corner, and a small group of coniferous and deciduous trees at the northwest corner (Photoplates 1
and 2). The latter group of trees lies on a raised area at the northwest corner and the remainder of
the lots is generally level to gradually sloping down from east to west (Photoplate 2). There is an
existing access across the roadside ditch near the shared line between the lots.
PROJECT PROPOSAL
The two lots are partially developed with a garage/shop on the eastern lot and an aboveground
drainfield on the other. A single-family home is proposed between the two existing features (Figure
3). It is positioned to allow direct connection to the existing drainfield and where vegetation removal
is limited to a grassy/weedy area (Photoplate 3). None of the native woody vegetation on these lots
will be removed to accommodate the home.
ENVIRONMENTAL AND HABITAT CONDITIONS
STATE AND FEDERALLY LISTED SPECIES AND CRITICAL HABITAT
Federally listed fish, bird, and mammals within the Olympic National Park and Jefferson County
were identified using the WDFW, National Oceanic and Atmospheric Administration (NOAA)
Fisheries, and United States Fish and Wildlife Service (USFWS) websites and are presented in Table
1. State and federal status and presence of critical habitat are also included in the table.

The Washington Department of Fish and Wildlife Priority Habitat and Species (PHS) website
(WDFW 2021) identifies presence of priority habitat and species areas within this area of Brinnon
as presented in Table 2 (Figure 5).

WASHINGTON DEPARTMENT OF NATURAL RESOURCES, NATURAL HERITAGE PROGRAM
The Washington Department of Natural Resources (WDNR), Natural Heritage Program identifies
19 sensitive, 4 threatened, and 1 endangered species of rare plants in Jefferson County (WDNR
2021). Golden paintbrush is listed as threatened by the WDNR and is also federally listed as
threatened (USFWS 2021).
JEFFERSON COUNTY CRITICAL AREA AND HABITAT MAPPING
The Jefferson County Critical Area Maps viewed through the online mapping website was used to
identify the presence of critical areas found within the vicinity of these lots (Figure 4). The map
indicates that the lots lie within a large wetland unit and that there is a Type 3 stream to the east.
However, there are no wetlands on these lots nor on the lots within this residential development.
There is a stream mapped across the development to the northeast of these lots, but a stream channel
was not observed in this location. There are spotted owl and marbled murrelet areas mapped offsite
to the north.

RESEARCH AND SITE INVESTIGATION
Birds
Marbled murrelet
Marbled murrelets nest in mature or old-growth forests near coastlines in which the trees are at least
32 inches diameter at breast height (dbh) with a multistoried canopy, moderate to high canopy
closure or an open crown canopy. Large vertical and horizontal snags are also present at various
stages of decay. These birds more commonly nest in forest stands that are greater than 500 acres
and less commonly nest in stands less than 100 acres. Murrelets typically utilize the largest tree in
the stand for their nests.
Yellow-billed cuckoo
Yellow-billed cuckoos are found in deciduous forests where they forage in dense trees and shrubs.
They nest in a tree or shrub usually 2 to 12 feet above the ground typically on a flimsy platform of
short twigs on a horizontal branch.
Streaked horned lark
Streaked horned larks are found in prairie and grassland, coastal beaches, and sparsely vegetated
shorelines along the lower Columbia River. This species nests and feeds in bare areas of fields and
pastures.
Spotted owl
Spotted owls are found in low to mid-elevation mature to old growth forests with dense canopies
consisting mainly of Douglas fir having several vertical layers of vegetation. They nest in trees with
broken tops and other natural hollows and in old stick nests of other species.
Harlequin ducks
Harlequin ducks are found in fast flowing rivers during the breeding season and move to slower
flowing water when with chicks. Rivers with islands or sand bars are preferred habitat for resting
and they are found in rocky coastal cliffs in the winter months. They nest in holes in trees, rocky
ledges, and occasionally on the ground.
Plants
The WDNR lists 24 sensitive, threatened, and endangered species that occur within Jefferson County
(WDNR 2021). The lots for which this assessment was completed are partially developed and
regularly maintained so there was no suitable habitat for the listed plant species. None of these
species were observed on these lots and there was no suitable habitat noted within the residential
development.
Wildlife Inventory
The January 2021 site visit observed no suitable habitat for the listed species as described above.
There are small groupings of trees on the lots, but they do not represent part of mature or old-growth
forest and include only a few deciduous trees. The research conducted for this project indicates
that the lots are not within critical habitat for any of the listed species. No other wildlife species
were observed on these lots during the site visit.

Critical Areas Assessment
The lots within this residential subdivision are mapped as containing wetlands according to the
Jefferson County Critical Areas map (Figure 4). The vegetation conditions, which include
maintained open land and pockets of trees, are not indicative of wetlands. Data to confirm the
absence of wetlands was collected in the lowest elevation area of the lots, which is in the northeast
corner where the vegetation was dominated by maintained grasses, hairy cat’s ear (Hypochaeris
radicata, FACU), and creeping buttercup (Ranunculus repens, FAC). The soil profile in this area
was composed of two compacted gravelly sandy loam layers. The upper 12 inches had a brown
(10YR 3/2) matrix color and below 12 inches, the soil had a yellow brown (2.5Y 3/2) matrix color.
Redoximorphic concentrations were not observed within either layer of the soil. Water was not
present during the February 12, 2021 site visit and there was no evidence of wetland hydrology.
There was also no evidence of water elsewhere on these lots. The vegetation criterion was met
because there was greater than 50 percent dominance by FAC species, but the area was determined
to upland because there were no positive indicators present for hydric soils or wetland hydrology.
The data collected in this area is indicative of conditions across the remainder of these lots, which
slope up to the southwest and west. There were no wetlands or streams observed within 300 feet
of the lots because of the dense residential development on all sides.
IMPACT ASSESSMENT
These lots are currently partially developed with a garage/shop on the eastern lot with groups of trees
on two sides. The western lot is undeveloped except for an existing aboveground drainfield. A
single-family home is proposed between the garage/shop and drainfield where maintained grass
dominates. The existing onsite structures were constructed without removal of any of the existing
groups of trees and because the home is proposed between the garage/shop and drainfield, there will
be no removal of woody vegetation for the current proposal. Therefore, the vegetation conditions
onsite will not change except where the house will be constructed (removal of the grass and weeds)
and will not change the condition of any potential habitat.
No-Net-Loss Assessment
The single-family home will introduce a new building to the neighborhood but because the
surrounding lots are fully developed, there will be no change to the habitat available to the listed
species. There will also be no change to the noise levels that can affect habitat use by the listed
species because of the developed conditions in this area. Stormwater generated on the developed
lots will discharge into the roadside ditch along the north line. There will be no increase to the
amount of stormwater onsite because of the current compacted conditions of the lots and the
placement of only a single residence. Because this project proposes no change to any suitable habitat
for the listed species and there will be no new impacts to habitat or critical areas , mitigation is not
proposed.

INTRODUCTION
Ecological Land Services, Inc. (ELS) has been contracted by Bing Selvog to complete a habitat
management plan (HMP) for the proposed single-family home on property at 60 Pinto Lane,
Jefferson County Tax Parcel Nos. 966900076 and 966900077, in Brinnon, Washington. This
property is in a portion of Section 34, Township 26 North, Range 2 West of the Willamette Meridian
(Figure 1).
STUDY AREA DESCRIPTION
These existing platted lots are on the southeast side of Pinto Lane within the residential neighborhood
of Lazy C Ranch on the west end of Brinnon (Figure 2). Both lots are currently developed with a
garage/shop on the eastern lot (077) and an above-ground septic system on the western lot (076)
(Photoplate 3). The remainder of the lots are composed of open maintained grounds with a line of
conifer trees along the east property line, a group of large western red cedar trees at the southwest
corner, and a small group of coniferous and deciduous trees at the northwest corner (Photoplates 1
and 2). The latter group of trees lies on a raised area at the northwest corner and the remainder of
the lots is generally level to gradually sloping down from east to west (Photoplate 2). There is an
existing access across the roadside ditch near the shared line between the lots.
PROJECT PROPOSAL
The two lots are partially developed with a garage/shop on the eastern lot and an aboveground
drainfield on the other. A single-family home is proposed between the two existing features (Figure
3). It is positioned to allow direct connection to the existing drainfield and where vegetation removal
is limited to a grassy/weedy area (Photoplate 3). None of the native woody vegetation on these lots
will be removed to accommodate the home.
ENVIRONMENTAL AND HABITAT CONDITIONS
STATE AND FEDERALLY LISTED SPECIES AND CRITICAL HABITAT
Federally listed fish, bird, and mammals within the Olympic National Park and Jefferson County
were identified using the WDFW, National Oceanic and Atmospheric Administration (NOAA)
Fisheries, and United States Fish and Wildlife Service (USFWS) websites and are presented in Table
1. State and federal status and presence of critical habitat are also included in the table.

The Washington Department of Fish and Wildlife Priority Habitat and Species (PHS) website
(WDFW 2021) identifies presence of priority habitat and species areas within this area of Brinnon
as presented in Table 2 (Figure 5).

WASHINGTON DEPARTMENT OF NATURAL RESOURCES, NATURAL HERITAGE PROGRAM
The Washington Department of Natural Resources (WDNR), Natural Heritage Program identifies
19 sensitive, 4 threatened, and 1 endangered species of rare plants in Jefferson County (WDNR
2021). Golden paintbrush is listed as threatened by the WDNR and is also federally listed as
threatened (USFWS 2021).
JEFFERSON COUNTY CRITICAL AREA AND HABITAT MAPPING
The Jefferson County Critical Area Maps viewed through the online mapping website was used to
identify the presence of critical areas found within the vicinity of these lots (Figure 4). The map
indicates that the lots lie within a large wetland unit and that there is a Type 3 stream to the east.
However, there are no wetlands on these lots nor on the lots within this residential development.
There is a stream mapped across the development to the northeast of these lots, but a stream channel
was not observed in this location. There are spotted owl and marbled murrelet areas mapped offsite
to the north.

RESEARCH AND SITE INVESTIGATION
Birds
Marbled murrelet
Marbled murrelets nest in mature or old-growth forests near coastlines in which the trees are at least
32 inches diameter at breast height (dbh) with a multistoried canopy, moderate to high canopy
closure or an open crown canopy. Large vertical and horizontal snags are also present at various
stages of decay. These birds more commonly nest in forest stands that are greater than 500 acres
and less commonly nest in stands less than 100 acres. Murrelets typically utilize the largest tree in
the stand for their nests.
Yellow-billed cuckoo
Yellow-billed cuckoos are found in deciduous forests where they forage in dense trees and shrubs.
They nest in a tree or shrub usually 2 to 12 feet above the ground typically on a flimsy platform of
short twigs on a horizontal branch.
Streaked horned lark
Streaked horned larks are found in prairie and grassland, coastal beaches, and sparsely vegetated
shorelines along the lower Columbia River. This species nests and feeds in bare areas of fields and
pastures.
Spotted owl
Spotted owls are found in low to mid-elevation mature to old growth forests with dense canopies
consisting mainly of Douglas fir having several vertical layers of vegetation. They nest in trees with
broken tops and other natural hollows and in old stick nests of other species.
Harlequin ducks
Harlequin ducks are found in fast flowing rivers during the breeding season and move to slower
flowing water when with chicks. Rivers with islands or sand bars are preferred habitat for resting
and they are found in rocky coastal cliffs in the winter months. They nest in holes in trees, rocky
ledges, and occasionally on the ground.
Plants
The WDNR lists 24 sensitive, threatened, and endangered species that occur within Jefferson County
(WDNR 2021). The lots for which this assessment was completed are partially developed and
regularly maintained so there was no suitable habitat for the listed plant species. None of these
species were observed on these lots and there was no suitable habitat noted within the residential
development.
Wildlife Inventory
The January 2021 site visit observed no suitable habitat for the listed species as described above.
There are small groupings of trees on the lots, but they do not represent part of mature or old-growth
forest and include only a few deciduous trees. The research conducted for this project indicates
that the lots are not within critical habitat for any of the listed species. No other wildlife species
were observed on these lots during the site visit.

Critical Areas Assessment
The lots within this residential subdivision are mapped as containing wetlands according to the
Jefferson County Critical Areas map (Figure 4). The vegetation conditions, which include
maintained open land and pockets of trees, are not indicative of wetlands. Data to confirm the
absence of wetlands was collected in the lowest elevation area of the lots, which is in the northeast
corner where the vegetation was dominated by maintained grasses, hairy cat’s ear (Hypochaeris
radicata, FACU), and creeping buttercup (Ranunculus repens, FAC). The soil profile in this area
was composed of two compacted gravelly sandy loam layers. The upper 12 inches had a brown
(10YR 3/2) matrix color and below 12 inches, the soil had a yellow brown (2.5Y 3/2) matrix color.
Redoximorphic concentrations were not observed within either layer of the soil. Water was not
present during the February 12, 2021 site visit and there was no evidence of wetland hydrology.
There was also no evidence of water elsewhere on these lots. The vegetation criterion was met
because there was greater than 50 percent dominance by FAC species, but the area was determined
to upland because there were no positive indicators present for hydric soils or wetland hydrology.
The data collected in this area is indicative of conditions across the remainder of these lots, which
slope up to the southwest and west. There were no wetlands or streams observed within 300 feet
of the lots because of the dense residential development on all sides.
IMPACT ASSESSMENT
These lots are currently partially developed with a garage/shop on the eastern lot with groups of trees
on two sides. The western lot is undeveloped except for an existing aboveground drainfield. A
single-family home is proposed between the garage/shop and drainfield where maintained grass
dominates. The existing onsite structures were constructed without removal of any of the existing
groups of trees and because the home is proposed between the garage/shop and drainfield, there will
be no removal of woody vegetation for the current proposal. Therefore, the vegetation conditions
onsite will not change except where the house will be constructed (removal of the grass and weeds)
and will not change the condition of any potential habitat.
No-Net-Loss Assessment
The single-family home will introduce a new building to the neighborhood but because the
surrounding lots are fully developed, there will be no change to the habitat available to the listed
species. There will also be no change to the noise levels that can affect habitat use by the listed
species because of the developed conditions in this area. Stormwater generated on the developed
lots will discharge into the roadside ditch along the north line. There will be no increase to the
amount of stormwater onsite because of the current compacted conditions of the lots and the
placement of only a single residence. Because this project proposes no change to any suitable habitat
for the listed species and there will be no new impacts to habitat or critical areas , mitigation is not
proposed.

Dear CLARENCE SELVOG:
The Department of Community Development is in the process of reviewing your a pplication. The
following information is needed to continue review of your project.
The proposed manufactured home is within a FEMA Flood Zone, it is required to submit a flood
elevation certificate prepared by a Washington State Licensed Engineer or Architect familiar with
FEMA regulations per Jefferson County Code (JCC) 15.15.070 (1)(b)(iii). The manufactured home
must be elevated on a permanent foundation such that the lowest floor of the manufactured home is
elevated one foot or more above the base flood elevation and be securely anchored to an adequately
anchored foundation system to resist flotation, collapse and lateral movement per JCC 15.15.080(2)
(c).
Additionally, the proposal is required to meet federal FEMA regulations which includes the
requirement of a Habitat Assessment by a Washington State Licensed Biologist that directly follows
the requirements laid out by the FEMA Puget Sound BiOp Floodplain Ha bitat Assessment
Worksheet (attached).
In addition, the FEMA flood zone extends the shoreline jurisdiction to cover all of your parcel and
therefore, requires a shoreline exemption to be approved. Please see the attached form, sign and
return it. In addition, the shoreline exemption requires additional fees. Please see the attached
invoice.
The proposal includes two parcels, they must be combined or tied together to approve the building
permit. You can apply for a lot consolidation land use permit to permanently combine the lots
together to one parcel or you can complete a restrictive covenant that ties the parcels together until
the building and other components are removed. Please see the attached restrictive covenant, have
it notarized and then return the original to Jefferson County Community Development for
Administrator Approval. Once the document receives administrative approval, the land use planner
will contact you to record the document with the Jefferson County Auditor.
Finally, the proposed project is within a seismic hazard. JCC 18.22 requires a geotechnical
evaluation for this property. Alternatively, you may submit a request for a geotechnical report waiver to
be reviewed.
Please submit the above information to the Department of Community Development within 90 days
of the date of this letter which would be 4/21/2021. Please call 360-379-4450 to speak with the

The submitted FEMA Flood Elevation Certificate indicates a Base Flood Elevation of 73.2 feet.
Additionally, the FEMA firm panel 53031C1283C confirms this elevation. Per Jefferson Count y Code
(JCC) 15.15.080 (2)(c):"Manufactured homes. All manufactured homes in the floodplain to be
placed or substantially improved on sites shall be elevated on a permanent foundation such that the

of the new manufactured home is within this geologically hazardous area, please submit

state stamp that addresses 18.22 JCC and supports the proposed location of the building.

The submitted FEMA Flood Elevation Certificate indicates a Base Flood Elevation of 73.2 feet.
Additionally, the FEMA firm panel 53031C1283C confirms this elevation. Per Jefferson County Code
(JCC) 15.15.080 (2)(c):"Manufactured homes. All manufactured homes in the floodplain to be
placed or substantially improved on sites shall be elevated on a permanent foundation such that the
lowest floor of the manufactured home is elevated one foot or more above the base flood elevation
and be securely anchored to an adequately anchored foundation system to resist flotation, collapse
and lateral movement."
From a building standpoint, this requires an engineered foundation plan with attachment points and
engineered flood openings for the foundation. Please contact our plans examiner at

Jefferson County has mapped your parcel as a geologically hazardous area. The proposed location
of the new manufactured home is within this geologically hazardous area, please submit

Approval Recommendation
Clarence Selvog and Barbara Petzoldt applied for a geotechnical report waiver during the course
of a Buildng Permit (BLD2020-00647) and Septic permit (SEP2021-00018) application. They
plan to construct a modular home and septic system upgrade. Their property is mapped as a
seismic area. I have reviewed the waiver request submitted by Clarence Selvog and Barbara
Petzoldt, available map and data, and completed the attached geohazard checklist. They will
implement applicable best management practices during construction. The building area has a
slope of about 4% and the parcel has an overall slope of 4%. Based on our available data, the
building site, proposed development, and analysis from the geohazard checklist I find that the
standards for a geotechnical report waiver, under Jefferson County Code 18.22.910, have been
satisfied.

INTRODUCTION
Ecological Land Services, Inc. (ELS) has been contracted by Bing Selvog to complete a habitat
management plan (HMP) for the proposed single-family home on property at 60 Pinto Lane,
Jefferson County Tax Parcel Nos. 966900076 and 966900077, in Brinnon, Washington. This
property is in a portion of Section 34, Township 26 North, Range 2 West of the Willamette Meridian
(Figure 1).
STUDY AREA DESCRIPTION
These existing platted lots are on the southeast side of Pinto Lane within the residential neighborhood
of Lazy C Ranch on the west end of Brinnon (Figure 2). Both lots are currently developed with a
garage/shop on the eastern lot (077) and an above-ground septic system on the western lot (076)
(Photoplate 3). The remainder of the lots are composed of open maintained grounds with a line of
conifer trees along the east property line, a group of large western red cedar trees at the southwest
corner, and a small group of coniferous and deciduous trees at the northwest corner (Photoplates 1
and 2). The latter group of trees lies on a raised area at the northwest corner and the remainder of
the lots is generally level to gradually sloping down from east to west (Photoplate 2). There is an
existing access across the roadside ditch near the shared line between the lots.
PROJECT PROPOSAL
The two lots are partially developed with a garage/shop on the eastern lot and an aboveground
drainfield on the other. A single-family home is proposed between the two existing features (Figure
3). It is positioned to allow direct connection to the existing drainfield and where vegetation removal
is limited to a grassy/weedy area (Photoplate 3). None of the native woody vegetation on these lots
will be removed to accommodate the home.
ENVIRONMENTAL AND HABITAT CONDITIONS
STATE AND FEDERALLY LISTED SPECIES AND CRITICAL HABITAT
Federally listed fish, bird, and mammals within the Olympic National Park and Jefferson County
were identified using the WDFW, National Oceanic and Atmospheric Administration (NOAA)
Fisheries, and United States Fish and Wildlife Service (USFWS) websites and are presented in Table
1. State and federal status and presence of critical habitat are also included in the table.

The Washington Department of Fish and Wildlife Priority Habitat and Species (PHS) website
(WDFW 2021) identifies presence of priority habitat and species areas within this area of Brinnon
as presented in Table 2 (Figure 5).

WASHINGTON DEPARTMENT OF NATURAL RESOURCES, NATURAL HERITAGE PROGRAM
The Washington Department of Natural Resources (WDNR), Natural Heritage Program identifies
19 sensitive, 4 threatened, and 1 endangered species of rare plants in Jefferson County (WDNR
2021). Golden paintbrush is listed as threatened by the WDNR and is also federally listed as
threatened (USFWS 2021).
JEFFERSON COUNTY CRITICAL AREA AND HABITAT MAPPING
The Jefferson County Critical Area Maps viewed through the online mapping website was used to
identify the presence of critical areas found within the vicinity of these lots (Figure 4). The map
indicates that the lots lie within a large wetland unit and that there is a Type 3 stream to the east.
However, there are no wetlands on these lots nor on the lots within this residential development.
There is a stream mapped across the development to the northeast of these lots, but a stream channel
was not observed in this location. There are spotted owl and marbled murrelet areas mapped offsite
to the north.

RESEARCH AND SITE INVESTIGATION
Birds
Marbled murrelet
Marbled murrelets nest in mature or old-growth forests near coastlines in which the trees are at least
32 inches diameter at breast height (dbh) with a multistoried canopy, moderate to high canopy
closure or an open crown canopy. Large vertical and horizontal snags are also present at various
stages of decay. These birds more commonly nest in forest stands that are greater than 500 acres
and less commonly nest in stands less than 100 acres. Murrelets typically utilize the largest tree in
the stand for their nests.
Yellow-billed cuckoo
Yellow-billed cuckoos are found in deciduous forests where they forage in dense trees and shrubs.
They nest in a tree or shrub usually 2 to 12 feet above the ground typically on a flimsy platform of
short twigs on a horizontal branch.
Streaked horned lark
Streaked horned larks are found in prairie and grassland, coastal beaches, and sparsely vegetated
shorelines along the lower Columbia River. This species nests and feeds in bare areas of fields and
pastures.
Spotted owl
Spotted owls are found in low to mid-elevation mature to old growth forests with dense canopies
consisting mainly of Douglas fir having several vertical layers of vegetation. They nest in trees with
broken tops and other natural hollows and in old stick nests of other species.
Harlequin ducks
Harlequin ducks are found in fast flowing rivers during the breeding season and move to slower
flowing water when with chicks. Rivers with islands or sand bars are preferred habitat for resting
and they are found in rocky coastal cliffs in the winter months. They nest in holes in trees, rocky
ledges, and occasionally on the ground.
Plants
The WDNR lists 24 sensitive, threatened, and endangered species that occur within Jefferson County
(WDNR 2021). The lots for which this assessment was completed are partially developed and
regularly maintained so there was no suitable habitat for the listed plant species. None of these
species were observed on these lots and there was no suitable habitat noted within the residential
development.
Wildlife Inventory
The January 2021 site visit observed no suitable habitat for the listed species as described above.
There are small groupings of trees on the lots, but they do not represent part of mature or old-growth
forest and include only a few deciduous trees. The research conducted for this project indicates
that the lots are not within critical habitat for any of the listed species. No other wildlife species
were observed on these lots during the site visit.

Critical Areas Assessment
The lots within this residential subdivision are mapped as containing wetlands according to the
Jefferson County Critical Areas map (Figure 4). The vegetation conditions, which include
maintained open land and pockets of trees, are not indicative of wetlands. Data to confirm the
absence of wetlands was collected in the lowest elevation area of the lots, which is in the northeast
corner where the vegetation was dominated by maintained grasses, hairy cat’s ear (Hypochaeris
radicata, FACU), and creeping buttercup (Ranunculus repens, FAC). The soil profile in this area
was composed of two compacted gravelly sandy loam layers. The upper 12 inches had a brown
(10YR 3/2) matrix color and below 12 inches, the soil had a yellow brown (2.5Y 3/2) matrix color.
Redoximorphic concentrations were not observed within either layer of the soil. Water was not
present during the February 12, 2021 site visit and there was no evidence of wetland hydrology.
There was also no evidence of water elsewhere on these lots. The vegetation criterion was met
because there was greater than 50 percent dominance by FAC species, but the area was determined
to upland because there were no positive indicators present for hydric soils or wetland hydrology.
The data collected in this area is indicative of conditions across the remainder of these lots, which
slope up to the southwest and west. There were no wetlands or streams observed within 300 feet
of the lots because of the dense residential development on all sides.
IMPACT ASSESSMENT
These lots are currently partially developed with a garage/shop on the eastern lot with groups of trees
on two sides. The western lot is undeveloped except for an existing aboveground drainfield. A
single-family home is proposed between the garage/shop and drainfield where maintained grass
dominates. The existing onsite structures were constructed without removal of any of the existing
groups of trees and because the home is proposed between the garage/shop and drainfield, there will
be no removal of woody vegetation for the current proposal. Therefore, the vegetation conditions
onsite will not change except where the house will be constructed (removal of the grass and weeds)
and will not change the condition of any potential habitat.
No-Net-Loss Assessment
The single-family home will introduce a new building to the neighborhood but because the
surrounding lots are fully developed, there will be no change to the habitat available to the listed
species. There will also be no change to the noise levels that can affect habitat use by the listed
species because of the developed conditions in this area. Stormwater generated on the developed
lots will discharge into the roadside ditch along the north line. There will be no increase to the
amount of stormwater onsite because of the current compacted conditions of the lots and the
placement of only a single residence. Because this project proposes no change to any suitable habitat
for the listed species and there will be no new impacts to habitat or critical areas , mitigation is not
proposed.

Please read this form carefully and be aware that, in applying for and receiving a permit for
development, you are knowingly and willfully seeking a waiver from the requirement of a professional
geotechnical report describing your Property, proposed development, and potential risk of earth
movement. Your Property contains a mapped Geologically Hazardous Area, a Critical Area as defined by
Chapter 18.22 of the Jefferson County Code. Mapped Geologically Hazardous Areas may contain site
features, such as soil, hydrology, or topography features that increase the risk of earth movement, which
may present a risk to life and property. In accordance with permitting the construction of the items
described and listed below within an Environmentally Sensitive Area, Applicant(s) acknowledge and
agree as follows:
1. Applicant(s) desire to construct a Septic system update and modular home. The Property is
located within a Geologically Hazardous Area within a Seismic Hazard area. Applicant(s) agree
that they are fully aware of the risks inherent in development in a Geologically Hazardous Area.
2. Applicant(s), as their own free and voluntary act, accept, and assume all risks of loss or damage
arising out of the conditions described herein and further agree to relieve Jefferson County, its
agencies, divisions, officers, agents, and employees of any liability, damages, claims, or other
expenses arising as a result of or allegedly as the result of the approval of the development and
the approval of the Applicant(s)’ proposed development.
3. Applicant(s) agrees to and shall hold harmless and indemnify the Jefferson County, its agencies,
divisions, officers, agents, and employees from and against any and all liability, loss, claims,
suits, damages, costs, expenses (including attorney’s fees) that may arise at any time, occur or
be generated as a result of any reduction in the fair market value of the Applicant(s)’ Property
and/or any damage to personal property or personal injury by reason of the conditions existing
now or any time hereafter on or around the Applicant(s)’ Property or due to any design,
development, or construction pursuant to the building permit, stormwater management system
approval, septic permit, or any other development permits issues thereunder by the Jefferson

4. If any term of this Waiver is to any extent invalid, illegal, or incapable of being enforced, such
term shall be excluded to the extent of such invalidity, illegality, or unenforceability; all other
terms shall remain in full force and effect.
5. All associated permits must be obtained or development must be substantially started within
one-year from the effective date of this Waiver. If this condition is not met, the Waiver shall be
void.
6. Development and associated permits must substantially comply with the Exhibit “A” Site or
Development Plan.
7. The approved site plan is in the Department of Community Development case file: BLD2020-
00647 and/or SEP2021-00018.

B. COVENANT
1. Specific Restriction and Covenant. The property described above, shall constitute a single
building site, and no lot or lots or any part thereof shall be transferred or conveyed in any manner
unless and until the building(s), structure(s) are made to conform to the then-existing zoning
provisions on a reduced site. This restrictive covenant shall not be removed unless such an
action is approved by the County.
2. Covenant Running with the Land. This restrictive covenant affects and restricts the
described property and shall be construed as a covenant running with and touching and
concerning the land and inuring to the benefit of the Owner(s), the public generally, and the
County.
3. Binding upon Successors and Assigns. This restrictive covenant shall bind and restrict the
land, the Owner(s), their heirs, grantees, successors and assigns.
4. Recording. Upon its execution, this Declaration shall be recorded with the Jefferson County

6. Compliance with Code Requirements. This Declaration does not amend or modify, nor is it
intended to amend or modify any requirements of the County's ordinances or any other law or
regulation dealing with or affecting the use of land or construction of improvements upon lands.
7. Estoppel. The Owners by this Declaration specifically estop themselves and all of their
successors and assigns and all persons presently or hereafter having any interest in the property
from asserting or contending in any manner that this restrictive covenant is not a full and

8. Severance. Invalidation of this covenant by judgment or court order shall not affect any of the
other covenants which shall remain in full force and effect.
