HomeMy WebLinkAbout60 22I In the Matter of Updating County Road Standards STATE OF WASHINGTON COUNTY OF JEFFERSON x x RESOLUTION NO.6 0 22 WHEREAS, Chapter 136-50 WAC - Standards of Good Practice — County Road Department Administration specifies policies and notifications to be coordinated between the County Engineer, county legislative authority, and the County Road Administration Board; and, WHEREAS, Chapter 136-50-050 WAC requires that the county legislative authority develop and by resolution or ordinance adopt written policies, within the limits of existing state law, that cover certain matters relating to county road department administration, maintenance, and construction; and, WHEREAS, Chapter 136-50-050(4) WAC states that the County Engineer shall propose and the legislative authority shall adopt by resolution or ordinance, and amend as needed, standards for all county roads per chapter 36.86 RCW and shall include design standards, construction specifications, and permitting for work within the county road right of way; and, WHEREAS, due to recent updates to Chapter 136-50 WAC, the County Road Administration Board (CRAB) is placing a renewed emphasis on ensuring that counties have adopted road standards; and, WHEREAS, Jefferson County road standards have been in place for many years and were adopted through various ordinances which created and amended Jefferson County Code (JCC) 18.30.080 — Development Standards — Roads; and, WHEREAS, JCC 18.30.080 adopts road design standards referenced in 160-50-050 WAC including but not limited to the Washington State Department of Transportation (WSDOT) Local Agency Guidelines (LAG) including Chapter 42 "City and County Design Standards", American Association of State Highway and Transportation Officials (AASHTO) A Policy on the Geometric Design of Highways and Streets; Federal Highway Administration Manual on Uniform Traffic Control Devices (MUTCD); and the WSDOT Standard Specifications for Road, Bridge, and Municipal Construction; and, WHEREAS, the Jefferson County road standards codified in JCC 18.30.080 satisfy the requirements of Chapter 36.86.RCW — Roads and Bridges Standards; and, WHEREAS, requirements for permits to work within the county road rights of way are codified in JCC 12.05 - Approaches to County Roads and JCC 13.56 - Accommodation of Utilities on Jefferson County Rights of Way; and, WHEREAS, the figures attached in Exhibit A and dated November 21, 2022 depict typical Jefferson County roadway standards including for road approaches; NOW, THEREFORE, BE IT RESOLVED that the Jefferson County Board of County Commissioners hereby acknowledges the Jefferson County road standards which are codified in JCC 18.30, JCC 12.05, and JCC 13.56. Furthermore, the Board adopts the typical roadway sections and road approach figures dated November 21, 2022 which are attached in Exhibit A and attached hereto. Finally, the Board recognizes that these figures represent typical roadway conditions and authorizes the County Engineer to use discretion to make exceptions and modifications to these standards when appropriate. From and after April 1, 1937, the width of thirty feet on each side of the center line of county roads, exclusive of such additional width as may be required for cuts and fills, is the necessary and proper right-of-way width for county roads, unless the board of county commissioners, shall, in any instance, adopt and designate a different width. This shall not be construed to require the acquisition of increased right-of-way for any county road already established and the right-of-way for which has been secured. RCW 36.86.020 Minimum standards of construction. In the case of roads, the minimum width between shoulders shall be fourteen feet with eight feet of surfacing, and in the case of bridges, which includes all decked structures, the minimum standard shall be for H-10 loading in accordance with the standards of the state department of transportation. When the standards have been prepared by the county road engineer, they shall be submitted to the county legislative authority for approval, and when approved shall be used for all road and bridge construction and improvement in the county. RCW 36.86.030 Amendment of standards —Filing. Road and bridge standards may be amended from time to time by resolution of the county legislative authority, but no standard may be approved by the legislative authority with any minimum requirement less than that specified in this chapter. Two copies of the approved standards shall be filed with the department of transportation for its use in examinations of county road work. RCW 36.86.040 Uniform standard for signs, signals, guideposts —Railroad grade crossings. The county legislative authority shall erect and maintain upon the county roads such suitable and proper signs, signals, signboards, and guideposts and appropriate stop, caution, warning, restrictive, and directional signs and markings as it deems necessary or as may be required by law. All such markings shall be in accordance with the uniform state standard of color, design, erection, and location adopted and designed by the Washington state department of transportation. In respect to existing and future railroad grade crossings over county roads the legislative authority shall install and maintain standard, nonmechanical railroad approach warning signs on both sides of the railroad upon the approaches of the county road. All such signs shall be located a sufficient distance from the crossing to give adequate warning to persons traveling on county roads. RCW 36.86.050 Monuments at government survey corners. The board and the road engineer, at the time of establishing, constructing, improving, or paving any county road, shall fix permanent monuments at the original positions of all United States government monuments at township corners, section corners, quarter section corners, meander corners, and witness markers, as originally established by the United States government survey, whenever any such original monuments or markers fall within the right-of-way of any county road, and shall aid in the reestablishment of any such corners, monuments, or markers destroyed or obliterated by the construction of any county road heretofore established, by permitting inspection of the records in the office of the board and the county engineering office. RCW 36.86.060 Restrictions on use of oil at intersections or entrances to county roads. No oil or other material shall be used in the treatment of any county road or private road or driveway, of such consistency, viscosity or nature or in such quantities and in such proximity to the entrance to or intersection with any state highway or county road, the roadway of which is surfaced with cement concrete or asphaltic concrete, that such oil or other material is or will be tracked by vehicles thereby causing a coating or discoloration of such cement concrete or asphaltic concrete roadway. Any person violating the provisions of this section shall be guilty of a misdemeanor. RCW 36.86.070 Classification of roads in accordance with designations under federal functional classification system. From time to time the legislative authority of each county shall classify and designate as the county primary road system such county roads as are designated rural minor collector, rural major collector, rural minor arterial, rural principal arterial, urban collector, urban minor arterial, and urban principal arterial in the federal functional classification system. RCW 36.86.080 Application of design standards to construction and reconstruction. Upon the adoption of uniform design standards the legislative authority of each county shall apply the same to all new construction within, and as far as practicable and feasible to reconstruction of old roads comprising, the county primary road system. No deviation from such design standards as to such primary system may be made without the approval of the state aid engineer for the department of transportation. RCW 36.86.090 Logs dumped on right -of -way —Removal —Confiscation. Logs dumped on any county road right-of-way or in any county road drainage ditch due to hauling equipment failure, or for any other reason, shall be removed within ten days. Logs remaining within any county road right-of-way for a period of thirty days shall be confiscated and removed or disposed of as directed by the boards of county commissioners in the respective counties. Confiscated logs may be sold by the county commissioners and the proceeds thereof shall be deposited in the county road fund. RCW 36.86.100 Railroad grade crossings —Obstructions. Each railroad company shall keep its right-of-way clear of all brush and timber in the vicinity of a railroad grade crossing with a county road for a distance of one hundred feet from the crossing in such a manner as to permit a person upon the road to obtain an unobstructed view in both directions of an approaching train or other on -track equipment. The county legislative authority shall cause brush and timber to be cleared from the right-of-way of county roads in the proximity of a railroad grade crossing for a distance of one hundred feet from the crossing in such a manner as to permit a person traveling upon the road to obtain an unobstructed view in both directions of an approaching train or other on -track equipment. It is unlawful to erect or maintain a sign, signboard, or billboard within a distance of one hundred feet from the point of intersection of the road and railroad grade crossing located outside the corporate limits of any city or town unless, after thirty days notice to the Washington utilities and transportation commission and the railroad operating the crossing, the county legislative authority determines that it does not obscure the sight distance of a person operating a vehicle or train approaching the grade crossing. When a person who has erected or who maintains such a sign, signboard, or billboard or when a railroad company permits such brush or timber in the vicinity of a railroad grade crossing with a county road or permits the surface of a grade crossing to become inconvenient or dangerous for passage and who has the duty to maintain it, fails, neglects, or refuses to remove or cause to be removed such brush, timber, sign, signboard, or billboard, or maintain the surface of the crossing, the utilities and transportation commission upon complaint of the county legislative authority or upon complaint of any party interested, or upon its own motion, shall enter upon a hearing in the manner now provided for hearings with respect to railroad -highway grade crossings, and make and enforce proper orders for the removal of the brush, timber, sign, signboard or billboard, or maintenance of the crossing. Nothing in this section prevents the posting or maintaining thereon of highway or road signs or traffic devices giving directions or distances for the information of the public when the signs conform to the "Manual for Uniform Traffic Control Devices" issued by the state department of transportation. The county legislative authority shall inspect highway grade crossings and make complaint of the violation of any provisions of this section. 18.30.080 Roads. 0 SHARE (1) General. The following shall apply to all public and private roads, including any road in a development subject to Chapter 18.35 JCC, Land Divisions: (a) Transportation facilities shall be designed and constructed in conformance with the following reference manuals and standards of the Jefferson County department of public works which are hereby adopted by reference in this code, including: (i) American Association of State Highway and Transportation Officials (AASHTO), A Policy on Geometric Design of Highways and Streets, Standard Specifications for Highway Bridges, and Roadside Design Guide; (ii) Washington State Department of Transportation (WSDOT) Local Agency Guidelines, Highway Design Manual, Bridge Manual, Construction Manual, Highway Runoff Manual, Hydraulics Manual, Plans Preparation Manual, Standard Specifications for Road, Bridge, and Municipal Construction, and Standard Plans for Road, Bridge, and Municipal Construction; (iii) Washington Department of Ecology Stormwater Management Manual; (iv) Federal Highway Administration Manual on Uniform Traffic Control Devices; (v) Institute of Transportation Engineers (ITE) Trip Generation Manual; and (vi) Transportation Research Board (TRB) Highway Capacity Manual, Special Report No. 209. (b) Bridges shall be designed and constructed in conformance with the standards of the department of public works identified by reference in this code. Bridge design and construction shall be certified by a licensed engineer. (c) Road signs and traffic signs shall be installed in conformance with the standards of the department of public works identified by reference in this title. (d) Drainage, erosion control, and stormwater management facilities shall comply with the requirements of the storm drainage standards contained in JCC 18.30.070 and the Washington Department of Ecology Stormwater Management Manual, and any other applicable Jefferson County standards. (e) The applicant shall submit plans for construction of roads, bridges, stormwater management facilities, and/or land disturbing activities regulated by this code to the department of public works for review and approval prior to commencing construction. (f) Clearing, grading, and construction of roads, bridges, utilities, and stormwater management facilities shall be inspected by the department of public works. In order to enable the department to conduct inspections in a timely manner, the applicant shall notify the department in a timely manner regarding the project construction schedule. The following road inspections are typically required: (i) Installation of temporary erosion and sediment control measures; (ii) Clearing and road subgrade preparation; (iii) Placing roadway gravel base; (iv) Placing roadway crushed surfacing top course; (v) Placing improved roadway surface (chip seal or asphalt concrete); (vi) Construction of stormwater management facilities; and (vii) Final plat review. Additional inspections may be necessary based on site -specific conditions or the nature of the project. (g) The department of public works may require development applicants to submit a traffic analysis prepared by a licensed engineer in order to determine the potential off -site impacts to public and private transportation facilities from proposed subdivisions. (h) Subdivision road systems shall provide access to the public road system at two locations, when feasible. One access location may be allowed based on a finding by the department of public works that a single access location is adequate to protect the public health, safety, and welfare. (i) Access to subdivisions from arterial and collector roads shall be restricted. Lots shall be accessed from an internal access road system, unless the lots are accessed from a local access road. Q) Developments shall make appropriate provision to ensure safe walking conditions for pedestrians and for students who walk to and from school. Construction of road improvements, sidewalks, trails, or bicycle facilities may be required in order to meet this standard. (k) Subdivisions shall make appropriate provision for transit and school bus stops. (1) When a proposed subdivision is adjacent to a county road, a right-of-way 30 feet in width from the roadway centerline shall be conveyed to Jefferson County by either statutory warranty deed or dedication in fee simple on the plat, if such right-of-way has not been previously conveyed. (m) Easements for private roads providing access to and/or internal circulation within subdivisions shall be 60 feet in width. Easement width may be reduced on the recommendation of the department of public works based on a finding that the public health, safety, and welfare will be protected and that the easement width is adequate for the construction and maintenance of roads and utilities. Where reduced access easement widths are proposed, parallel utilities easements may be required. (n) Access easements from the county road system to the subdivision shall be provided consistent with the requirements of this code. Access from the public road system shall be depicted on the final plat. (o) Subdivision road names shall be approved by the board of county commissioners based on a recommendation by the department of public works and in compliance with Chapter 12.20 JCC, 911 Emergency Locator System. (p) Subdivisions shall establish an agreement for the continuing maintenance of private roads either by recording a separate instrument and referencing said instrument on the plat or by declaring a maintenance agreement on the plat. The applicant shall submit the maintenance agreement to the department of public works for review and approval prior to final plat approval. (q) All required construction of roads, bridges, utilities, and stormwater management facilities shall be inspected and approved by the department of public works prior to final development approval. (r) Developments proposing access to county collector roads and state highways shall make appropriate access improvements to ensure that mobility on these roadways is not degraded. The design of access improvements shall be reviewed and approved by the Jefferson County engineer for county roads and by the Washington Department of Transportation for state routes. (s) Subdivision applicants may post a surety guaranteeing completion of subdivision improvements within one year of final plat approval. The surety shall be reviewed and approved by the department of public works. The surety shall be for 200 percent of the cost of constructing the improvements based on an estimate prepared by a licensed engineer. In the event that the applicant does not complete construction of improvements within one year, the department of public works shall be authorized to complete the construction and pay for the work from the surety account. Surety shall not be accepted for water supply development other than distribution facilities. (t) A maintenance bond guaranteeing any improvements required by this code for two years may be required by Jefferson County as a condition of final plat approval. Maintenance bonds shall be approved by the department of public works. (u) Applications requiring review by the department of public works to meet the requirements of this section shall be assessed hourly review fees in accordance with the Jefferson County fee schedule. By making application, the applicant agrees to reimburse the department for its expenses even if the proposal is denied by subsequent action of the county or the proposal is otherwise not completed. (v) Modifications to design and construction standards for a specific road project may be approved by the county engineer. (2) Public Roads. (a) General. (i) The Jefferson County engineer is responsible for the design and construction of all county roads. (ii) The standard right-of-way width is 60 feet for all public roads. (iii) Roadway monumentation shall be approved by the department of public works. (iv) Road access permits are required for access to county roads. Applications will be reviewed by the administrator for the requirements of the environmentally sensitive areas overlay district (see Article VI-D of Chapter 18.15 JCC) and of the State Environmental Policy Act (Article X of Chapter 18.40 JCC) prior to being approved by the county engineer. Such permits shall be limited as follows: (A) The number of access points along roads shall be limited to one per parcel, except: • For agricultural access; • When the parcel topography makes a single access point impractical for the entire parcel; • When access is being provided for commercial uses with 20 or more parking spaces; or • When additional access points are required or approved by the county engineer. (B) New access points to arterial roads shall not be allowed if reasonable access from any other road is available. (C) Road access points shall have a clear and unobstructed sight distance in both directions adequate to ensure public safety. Appropriate site distances shall be determined by the county engineer, based on speed limit, roadway surface, and other pertinent factors. (D) Storm drainage and culvert sizing shall be based upon engineering analysis and the standards of JCC 18.30.060(2) and 18.30.070. Maximum length of surface drainage for roadside ditches before discharging onto adjacent property or into natural drainageway shall be 1,000 feet. (E) The permits shall be conditioned to address impacts to environmentally sensitive areas or as indicated by SEPA analysis, if applicable. (F) The county engineer shall have the authority to approve or deny all road access permits, which decision is final and not subject to administrative appeal. (b) Road and Right -of -Way Dedication. (i) Where any public road right-of-way abutting a property proposed for a development is subject to a conditional use permit or to Chapter 18.35 JCC, Land Divisions, and has insufficient width to conform to the county's adopted road standards for the class of road involved, the county engineer may: (A) Require the dedication of sufficient additional right-of-way to bring the abutting half of the right-of-way (measured from the existing county road centerline) into conformance with the adopted standards; and (B) Obtain additional easements to cut and fill on the subject property adjacent to the county road, and to provide for drainage of surface and stormwater runoff by directing the runoff along or into natural drainageways on lots adjacent to the county road. Such drainage should be designed and mitigated to avoid or minimize impacts to the environment and to the affected properties. (ii) The county may accept the dedication of new county roads and rights -of -way subject to the following standards: (A) Only if all of the following criteria are met: • The road right-of-way is at least 60 feet in width and is dedicated to Jefferson County in fee simple; • The road meets all other county standards; and • An evaluation by the county engineer deems the road to be of general public benefit. (B) When roads are proposed to be dedicated to Jefferson County, the county engineer shall make a report to the board of county commissioners regarding the practicality and necessity of accepting the dedication, the effect of the dedication on traffic circulation, and any other matters deemed to be material by the county engineer. (C) All road rights -of -way dedications shall be processed in accordance with final plat procedures contained in Chapter 18.35 JCC, Land Divisions. (c) Road Vacations. All applications to the board of county commissioners seeking vacation of a county road right-of-way or any portion of one shall be subject to the requirements of Chapter 12.10 JCC, Road Vacations. Agenda Date: November 21, 2022 Subject: A Resolution Related to Jefferson County Road Standards Statement of Issue: Adoption of a Resolution related to Jefferson County's road design and construction standards. Analysis/Strategic Goals/Pro's Et Con's: Due to recent changes to 136-50 WAC, Standards of Good Practice - County Road Department Administration, the County Road Administration Board (CRAB) is placing renewed emphasis on ensuring that counties have adopted road standards. Counties are required by 36.86 RCW and 136-50 WAC to adopt county road construction standards. Jefferson County complies with the above requirement since its road standards have been codified in JCC 18.30.080 for many years. JCC 18.30.080 adopts standards including but not limited to the Washington State Department of Transportation (WSDOT) Local Agency Guidelines (LAG) including Chapter 42 "City and County Design Standards", American Association of State Highway and Transportation Officials (AASHTO) A Policy on the Geometric Design of Highways and Streets; Federal Highway Administration Manual on Uniform Traffic Control Devices (MUTCD); and the WSDOT Standard Specifications for Road, Bridge, and Municipal Construction. Road construction standards imposed through JCC 18.30.080 apply to short plats, long plats, and public county roads, but do not apply to logging roads, agricultural roads, or driveways. To graphically depict their road standards, many Washington counties adopt typical roadway exhibits which are primarily related to roadway and shoulder width. These exhibits also usually include requirements such as minimum surfacing depth and type, embankment slope angle, turn -around area, etc. Public Works has used typical roadway exhibits for years and has taken this opportunity to update these drawings. They are included with this Resolution as Attachment A so that they can be formally adopted. Existing Jefferson County road standards also include requirements and standards for building an approach to a county road (JCC 12.05 Et 18.30.080). RCW 36.75.130 requires parties to obtain permission from the county before building an approach to a county road and allows the county to adopt "reasonable rules" for building said approaches. JCC12.05.030 adopts AASHTO and WSDOT standards while also leaving much discretion to the County Engineer or Department of Public Works O Regular Agenda Page 2 of 3 their designee. Jefferson County, like most counties, uses an exhibit to graphically depict a typical road approach to convey standards to applicants. Public Works has taken this opportunity to update this road approach exhibit as well. Many Washington counties require all or some road approaches to be paved for a certain distance when connecting to a paved county road. Paved road approaches protect the edge of the paved county road which otherwise is often damaged by road approaches. Paving also reduces gravel tracking onto county roads which is detrimental to bicycle travel and which can present hazards to motorcycles or other vehicles. Paving also helps limit stormwater sedimentation by reducing sediment transport onto the county road system. Although not an entirely new requirement, Jefferson County has never formally adopted a policy regarding paving requirements for road approaches, and has left this matter up to the discretion of the County Engineer. An updated road approach exhibit included in Attachment A, proposed to be formally adopted by the Board via this Resolution, will require the first fifteen (15) feet of any new road approach to be paved when the road will serve multiple parcels including all short and long plats, a commercial or industrial site that with 30 or more trips per day (15 in and 15 out), or for any approach which intersects a county road with an ADT of 1,000 vehicles per day or more. Utility work in the right of way requires permits issued through the Public Works office. There are no utility standard changes proposed in this Resolution. Fiscal Impact/Cost Benefit Analysis: With the exception of new requirements to pave some private road approaches, adoption of this Resolution does not significantly alter the road standards which have been in place in Jefferson County Code for many years. Updates to the road approach standard to require paving in some cases will come at the expense of the property developer. This paving standard is now common with many counties for the aforementioned reasons.
