At present the public access provided for the entire Port Ludlow Development has been installed. This access is sufficient to meet public access requirements for not only the proposed Marina expansion, but also the entire proposed uplands development. Although the Jefferson County Shoreline Master Program contains no specific requirements to provide public access, the Washington State Shoreline Management Act contains broad policy guidelines that state that projects should "preserve and enhance public access or increase recreational opportunities for the public along shorelines." Therefore, when applying for a new permit, such as the requested Shoreline Permit for the marina expansion, the Department of Ecology, the agency with ultimate responsibility to enforce the State Shoreline Program, will look for public access components in every project. The Port Ludlow Marina is part of the overall property known as the Ludlow Bay Village. The recorded Covenants, Conditions and Restrictions (CC&Rs) for the Ludlow Bay Village contains an entire section declaring public access for the project. There are recorded public access easements throughout the property shown on the recorded plat filed on June 6, 1994, recorded in vol. 6, page 228. The CC&R language states that these Public Access Tracts "shall be available to the general public for passive recreational use, such as walking, bird watching, and the like, during daylight hours..." See attached portions of the recorded plat, Exhibit A. As the marina is a part of the Ludlow Bay Village, the CC&Rs apply to this facility. The dedicated Public Access Tracts should more than satisfy requirements to provide public access for the proposed marina expansion. In fact, with the approval of the Port Ludlow Village preliminary plat application (which encompasses the marina along with proposed restaurants, and residential lots) dated May 1993, the Hearing Examiner recommended the open space and recreation proposals for the subdivision should LOG,lTEM # ''1 Page -LOfJ.f- -.... The CC&Rs relating to the public access easements were recorded June 9,1994 in compliance with the plat approval. Additional public access has been provided in the form of transient moorage slips within the marina. There are 40 slips currently available at the guest moorage dock open to the public - 37 slips on A dock, and the remainder can be found as needed on any given day depending on marina usage. The marina's policy encourages visitation by the boating public and kayakers. Another form of public access provided by Port Ludlow is for kayakers. Currently, kayaks can be loaded on the stairs next to B - dock. Another area people can get access to the water is from a set of stairs to the beach on the west side of the Inn. The applicant Olympic Property Resources group believes it has satisfied the mandate of the Washington Shoreline Management Act to enhance public access and increase recreational opportunities for the public along the shoreline.
