Background and History o SEP A and rules: Chapter 197 -11 WAC o SEP A determination: probable sig. adverse env. impacts o County-directed EIS to address potential impacts of marina expansion; evaluate alternatives, including "no action" o Reid-Middleton is consultant that will dratt EIS for County; contracted by applicant o Programmatic FEIS issued in 1993 as part of master plan for Port Ludlow MPR. Sect. 3.90 of the MPR Code addresses env. review required for new resort development, specifically that an SEIS (or new EIS) needed before County issues any building permits. SEIS under WAC 197-11-620. o Subsect. 3.904 provides details on scope of SEIS. This SEIS is intended only for marina expansion. No bldg. permits issued until complete SEIS. o Reason for separate process is complexity of shoreline development and involvement of other agencies with jurisdiction: State Depts. of Ecology, Nat. Res., and F&W; and Federal authorities: Army Corps, NMFS, USFWS. They are involved in scoping and reviewing EIS and other studies, including Biological Evaluation, an ESA tool. Purpose and Intent of Meeting o Allow for public comment and to promote public participation in determining the range of proposed alternatives, mitigation measures, and probable significant adverse environmental impacts to be discussed in EIS o Since EIS is required to analyze sig. env. impacts only, scoping is needed to identify and narrow the topics o Not a meeting to identify who is against or for anyone of the alternatives, but rather an opportunity for the community to help identify potential impacts that need to be analyzed in the EIS . Next Steps o County prepares SEIS Scope document incorporating comments. o DEIS is noticed to public, followed by 30-day comment period. Final EIS follows, then permit decision no sooner than 7 days after. Process as outlined in old SEP A implementing ordinance. o (Appeal period for DS provided for in old SEP A ord. expired Oct. 13.) o Permit decision by DCD following Shoreline Master Program (local tool to implement Shoreline Management Act). Marinas are "Primary Use" in Urban shoreline designation. o Other permits: HP A; COE permit after consultation with Fed. services. No County bldg. permit until complete SEIS. .
