It appears that you (ORM) want phased review of the marina expansion project under SEPA. It appears that the SEPA regulations at least as you have laid them out, may permit that. But you acknowledge that there is a need for full SEPA review of a unified resort plan before any building permits can be issued for the marina or any portion of the resort plan. So it appears that you want to get to the point where the marina expansion has passed SEPA review and has County land use approvals but can't be built or even started. Why can't it be built or even started? Because those steps cannot occur without the second full-blown SEPA review of a unified resort plan. The County worries: What else will be proposed before the County sees a single unified resort plan; Indoor tennis courts, sports and pool complex, amphitheater and yacht club might all come to be proposed before there is a unified resort plan. All might be arguably independent of a unified resort plan and thus entitled to phased SEPA review. In other words, ORM gets to the resort plan step by step without a single unified plan. Then the County fears that piecemealing has occurred in violation of 3.902(1) of the MPR Ordinance. This is a real slippery slope and the County needs some explanation as to why it should not feel uncomfortable about this. Please confirm that paragraph #1 is correct.
