However, when I went to the URL cited in the article, the rules don't seem to be posted yet. In any case, please consider if and how the new rules would affect the FSEIS for the Port Ludlow Marina expansion. It may simply be a case of editing the references in the document, as apparently the decision is to allow liveaboards to continue (at least up to 10% of the slips of a marina). What percentage of the Port Ludlow Marina slips are assigned to liveaboards currently? Jeff Schreck is cc'd on this message for his information and input. The new rules suggest. that as' many as 10 ... percent of marina slips overstate land CflD be 'a$si~ed,. to. liveaboards, although adjustments are allowec1with approval of local government. Under the rules,localgov- ernments also can control resi'" dential use of. opeh moorage areas. The new regulations fol- lowed extensive public com- ments after Commissioner of Public Lands Doug Sutherland took office nearly two years ago and revisited a policy set by his predecessor, Jennifer Belcher. No phaseouts Belcher's policy would have phased out liveaboards as mari- nas renewed their leases of state land, something Suther- land said went too far. "Those who live aboard their boats can be SUre that they will continue to be flU important part of Washington's way of life," Sutherland, said. The, rules, which define the intent of the 1984 Aquatic Lands Act, makesa,di.stinction between vessels . and, floating houses. Marinas are required to use "best management prac- tices" to avoid' envirolUhental damage. The rules, approved Oct. 1, are expected to go into effect about mid-November, 31 days after filing with the state's code reviser. Infonnation about the rules can bEl found on the agency's .
