I reviewed and discussed this with Stacie (Airport Planner) and it is very interesting. We will seek comment
(again with a re-notice once we get the revised information we are waiting for) from The Corp (and other
agencies) on the Marrowstone project and they will have the opportunity to review and comment. We will see if
this is then an issue or not.
Also, I have not yet seen the study you mentioned in your voice mail of today.

Attached is the relevant portion of a Sept. 16/17 PDN article -- my only source of info so far on this. I haven't
looked at the airport file yet for more details, but the Marrowstone file has a COE permit document about case
law applied by the Corps that ditches connected to wetlands are considered to be tributaries. That's why I thought
there might be relevance to the Marrowstone ditches proposed for construction of the PUD's waterlines. Would
you check with the Airport permit reviewer and let me know what you learn?

Thanks for letting me know about the other reviewers.
I thought the Corps of Engineers action regarding the drainage ditch under the runway airport might have some
relevance to the Marrowstone permit review. Do you see any connections?

requested comments from. The comment period ended June 19th, 2005.

I understand that the hearings examiner is out of the SEPA appeal loop on the county's determination,
but I'm curious whether the other permitting agencies have indicated their consensus with the county's
position. I didn't see anything to that effect in the permit file last week, but perhaps its still too soon for
them.

Hi Nancy,
I mentioned that a determination that a proposal is exempt from SEPA is final per UDC
8.10.6.c(1):
The responsible official will determine the applicability of a categorical exemption.
The determination by the responsible official that a proposal is exempt from SEP A is
final. None of the procedural requirements of this Section 8.10 ( except as provided in
WAC 197-11-305 and this Section 8.10.6(c) apply to an exempt proposal.
