Enclosed are 2 DOH documents that recognize that the PUD has DOH approval for the extension of water
lines onto Marrowstone Island. The first approves our project report, which amends the PUD's approved WSP,
the second is recognition of our additional treatment at the Sparling well which will provide the PUD with sufficient
water for the distant future.
Also I will send some links to the sections of the RCW that deals with water rights for municipalities.
RCW 90.03.386 para (2). Which simply states that the PUD can use it water rights anywhere within its approved
service area.

Attached is the .pfd file for the Marrowstone summary judgement on the LUD formation.
Judge Williams ruled that:
"The Court finds that formation of the LUD is not precluded even though at the
time of the formation of the LUD the specific improvements contemplated were not
within the specific provisions of the public water system coordination act or the
PUD's own water service plan. Those plans must be amended. however. prior to
any construction of the proposed LUD."
As I stated in my earlier comments on MLA05-00276, there has been no programmatic
SEPA review of the impacts of the Marrowstone system on the Chimacum Creek sub-
basin that will be the source of Marrowstone water. Lacking to date is relevant SEPA
review of:
(1) the PUD's 2004 Water System Plan update;
(2) a DOH-required amendment to that WSP for the new Marrowstone system;
(3) the PUD's engineering Project Report for construction of the Marrowstone
system;
(4) Marrowstone construction permits, which DCD deemed to be SEPA-exempt,
despite adjacent wetlands and shoreline considerations
(5) proper completion, with SEPA, of an amendment to the County's Coordinated
Water System Plan referred to above in Judge Williams' ruling.
The Marrowstone water system has almost successfully eluded programmatic
environmental review, a review that has nothing to do with 8" pipes. The project has
also been phased in such a way as to avoid SEPA review of necessary and known
under-water components of the water system.
If the requested permits in MLA05-00276 are issued, they will not be consistent with the
existing Jefferson County Coordinated Water System Plan. WUCC approval of the
Marrowstone service area is not a sufficient CWSP amendment. Such an amendment
needs to be a legislative/SOCC decision with prior SEPA notice and determination, and
then given final DOH approval. None of that has happened yet.
How and when does the County intend to address the CWSP inconsistency?

revicwed the r~pon and the 1l111nwing items are needed prior to project approval.
I. The C.1P.lCity nnalysis in this report includes two proposed sources (Four Comer #1 amI #2) with a
tutal <.:apacity of 300 gallons per minute (gpm). There an: currently no water rights associated
with these sourcl.:S, Jefferson County Public Utility On;trict's mtent was to transfer water rights
from the Sparling we 11 field to these wells. However, it is my understanding that the Department
of Ecology may not allow this. Please explain what other options arc being considered to
obtain the additional source capacity. If a new source capacity strategy is pursued, please
submit a revised project report,
Regulations establishing a schedule of fces for review of planning, engineering, and construction
documents were adopted July 1, 2004 (WAC 246-290-990). An itemized bill tor $377 is enclosed,

Thank you for submitting a preliminary design project report for the proposed iron-manganese
project as mentioned above, received in this office on September 30, 2005. The report describes
the iron/manganese water quality problems in the system and outlines standard industry
corrective measure options, We accept the conclusions of this preliminary design report.
When submitting the Project Report and Construction Documents, please complete and include
the enclosed "Iron & Manganese Removal Facilities for Small Systems Submittal Checklist."
If this project is intended to increase production of th~ Sparling Well #2, please complete and
submit the enclosed Water Rights Self Assessment fonn.
