Please include the following comments in the above-mentioned file that is to be presented
to the hearing examiner.
The Department of Community Development is noted for its thorough review and
analysis of individual residential projects that sometimes take months to get to the
granting of the permit. Every part of the application process must be complete and
correct.
The application of record is for the entire Marrowstone Island Water Project yet, only
phase 1 of the wetlands delineation report is included (the phase 2 delineation project was
just approved at the Dec. 14,2005 PUD #1 Board of Commissioners Meeting). The
parcel map that has been submitted is not current - it is outdated and does not show
subdivisions or short plats that have been completed in the last ten years, despite the Nov.
15,2005 date. The application does not include the pipelines that will breach the state
and county roads nor those pipes being planned for private road easements. In short the
application is incomplete and the permit should be denied until and when the applicant
can file a complete application.
On the surface it appears that a double standard is being applied to this application!
Bringing an incomplete application forward by a public entity for public comment while
holding the individual residential applicant accountable for hislher complete and correct
application. I sincerely hope that this is only a perception, and not a reality. Jefferson
County would be wise to carefully review this application for completeness and
correctness before proceeding further. How can one make a decision for the entire
project based on only part of the needed materials?
PUD # 1 has repeatedly stated that they will provide water service to every parcel.
Because of phase 1 of the wetland delineation report, the preceding statement is incorrect.
The fire station on Flagler Rd and the remaining parcels north to the backwaters of
Mystery Bay will not be serviced. How many other parcels will be eliminated from the
project in phase 2? The people of Marrowstone deserve to know what they will have to
finance.

The Shoreline Management Master Program, Section 5.200 (Utilities) Policy 3 states that
"utilities should be located to meet the needs of future populations in areas planned to
accommodate this growth". Because of the complexity of and the multitude of state
compliance requirements, it is not clear if the PUD has:
1. Planned for future growth.
2. The water rights to serve Marrowstone Island.
3. Even the capacity to serve the existing residences.
These three statements need to be analyzed carefully and completely by the county in
accordance with current statutory requirements.
This application does not speak to the ability of the PUD to sustain water service over a
long period of time nor does it mention service to the private golf course on the island. A
golf course uses a tremendous amount of water through the dry season and will have an
impact on the long-term sustainability of water service. Nor does it speak to the impact
on adjacent wells to the well supplying the water to Marrowstone.
This permit application does not deserve to be granted at this point in time! Too much
information is missing and too many important questions need to be answered before a
permit is to be granted!
