Johnson, RE: MLA05-00276 Type III Land Use Application: Shoreline Conditional Use and Substantial Development Permit This project should be immediately stopped for the following reasons: The Board of County Commissioners stands in violation of West em Washington's Growth Management Hearings Board Orders, as stipulated in Jefferson County's Resolution No. 13-3, specifically page 3 item #5, and page 4 item #6. This Resolution, dated 2-19-03, contains a performance criterion which expired a year ago concerning a public water supply to Marrowstone Island. Additionally, the above resolution fails to meet groundwater protection on Marrowstone Island itself. In order meet groundwater protection guidelines, it is necessary to decommission any and all wells, even those used for irrigation, of those households and/or lots that connect to a public water supply. Failure to do so will continue to add to the saltwater intrusion problem on the island. Jefferson County PUD Resolution 2004-009, adopted April 21, 2004, Section 1 states the water system "will be designed to ensure the ability to serve Fort Flagler and residential properties at rural densities in accordance with the existing zoning regime for Marrowstone Island." This indicates all households will be able to hook up to public water. Recently the PUD stated only 300 households will be able to connect to public water. County census data in 2000 for Marrowstone indicates 585 households. In addition, the Department of Community Development agrees about 10 building permits per year are issued for Marrowstone adding at least another 50 households. Which half of island residents get public water and which half goes without? This project fails to provide for "future needs" as specified in the Shorelines Management Master Program Section 5.200 Utilities, Performance Standards item #3. 1 This project is not exempt from SEP A review. Wetlands and roadside ditches are not categorically exempt form SEPA review under WAC 197-11-800(23)(preamble), WAC 197-11-756, and WAC 222-16- 010, therefore the conditions ofW AC 197-11-800(23)(b) do not hold true for this project. This project fails to plan properly for properties along State Route 116 where waterfront lots are not big enough to have septic systems on them. These septic systems were built on lots on the other side ofSRl16 meaning proposed water lines will be in too close a proximity to the septic lines. In order to determine if the Quimper water system has enough water to supply Marrowstone Island, a pump test will be required on the Sparling well to prove it can actually pump its water right of 2250 gallons per minute once the additional treatment facilities are in place. The Department of Ecology expresses doubt about the well's ability to meet its water right. Litigation will most likely take place regarding the Sparling well and its current use as a primary source of water versus its permitted use as a secondary source of surface water for the City of Port Townsend. When the PUD gained ownership of the Sparling well conditions where placed on the well by the Department of Ecology. The most important condition is that the static water level in the well could not change. At this time, according to the Department of Ecology, the Sparling well has dropped at least 12 feet in level. RCW 90.54.140 calls for the "protection of ground water aquifers which are the sole drinking water source." This project provides NO protection for current drinking water sources. All Island owners with good drinking water wells have a "first in time, first in right" protection for water usage under state law. This means that our rights cannot be impaired. Since the soils on the island are vital to the aquifer, (see Jefferson County UDC Section 18. 15.240(3)(a), any trenching for pipelines will disturb geohydraulic flow which recharges the aquifer. The proposed water system project will usurp our rights. In addition WAC 173-200-030(2)(a) prevents degradation of our current water supply. Critical aquifer recharge areas are naturally susceptible due to the existence of permeable soils or a seawater wedge in coastline aquifers. Certain overlying land uses can lead to water quality and/or quantity degradation. The following classifications define critical aquifer recharge areas. (I) Susceptible aquifer recharge areas are those with geologic and hydrologic conditions that promote rapid infiltration of recharge waters to groundwater aquifers. For the purposes of this Article VI-E, unless otherwise detennined by preparation of an aquifer recharge area report authorized under this article, the following geologic units, as identified from available State of Washington Department of Natural Resources geologic mapping, define susceptible aquifer recharge areas for east Jefferson County: (a) (b) (c) (d) (e) (t) (g) "(h) (i) :'0) ~k) (I) Alluvial fans (Ha); Artificial fill (Hx); Beach sand and gravel (Hb); Dune sand (Hd); Floodplain alluvium (Hi); Vashon recessional outwash in deltas and alluvial fans (Vrd); Vasbon recessional outWash in meItwaterchannels (Vro); Vaabon ice.eo.Qtact stratified drift (Vi); t) ~). J. ~ fc} /-~ ~ ;)~- ~ (2) Those areas meeting the requirements of susceptible aquifer recharge areas (above) and which are overlain by the following land uses as identified in this code are subject to the provisions of the protection standards in this article: (a) AU industrial land uses; (b) All commercial uses; (c) All rural residential land uses: (i) Requiring a discretionary use or conditional use permit, or (il) With nonconforming uses that would otherwise require a discretionary use or conditional use pennit; (d) Unsewered planned rural residential developments; (e) Unsewered residential development with gross densities greater than one unit per acre. (3) Special aquifer recharge protection areas include: (a) Sole source aquifers designated by the U.S. Environmental Protection Agency in accordance with the Safe Drinking Water Act of t 974 (Public Law 93-523); (b) Special protection areas designated by the Washington Department ofEcoJogy under Chapter 173- ~OQ WAC; (c) Wellhead protection areas determined in accordance with delineation methodologies specified by the Washington Department of Health under authority of Chapter 246- 290 WAC; (d) Groundwater management areas designated by the Washington Department of Ecology in cooperation with local govemmentunder Chapter 173-1 00 WAC. (4) Seawater intrusion protection zones (SIPZ) are aquifers and land overlying aquifers with some degree of vulnerability to seawater intrusion. SIPZ are def'tned either by proximity to marine shoreline or by proximity to groundwater sources that have demonstrated high chloride readings. All islands and land area within one-quarter mile of marine shorelines and associated aquifers together compose the coastal SIPZ. Additionally, areas within I ~OOO feet of a groundwater source with a history of chloride analyses above 100 milligrams per liter (mgIL) are cate. goriud as either at risk (betw~ 2P m&lL.fl\d 200 mgIL) or high risk (over 200 mgfL) SIPZ. (1) The antidegradation policy of the state of Washington, Is generally guided by chapter ~ RCW,th, Water Pollution Control Act, and chapter 1mM. RCW, the Water Resources Act of 1911.
