Region 6 Office: 48 Devonshire Road - Montesano, Washington 98563-9618 - (360) :2~9-4628 May 17,2006 \",,'1 "iI,~ " " '.\ ,j :' , e,..' \ '" 1oj,- Jefferson County PUD #1 Attn: James Parker Post Office Box 929 Port Hadlock, W A 98339 Dear Mr. Parker: SUBJECT: Hydraulic Project Application Package, Beckett Point Sanitary Improvements, Discovery Bay, Tributary to Strait of Juan de Fuca, NE 1/4, Section 23/24, Township 30 North, Range 02 West, Jefferson County, WRlA 17.9060, WDFW Log No. NR-104806-02 The Washington Department ofFish and Wildlife (WDFW) received your application for a Hydraulic Project Approval (HP A) on March 27, 2006 and issued an incomplete application letter on May 4, 2006, The Revised Code of Washington (RCW 77,55) states "in the event that any person or government agency desires to construct any form of hydraulic project or perform other work that will use, divert, obstruct, or change the natural flow or bed of any of the salt, . , waters of the state, such person or government agency shall, before commencing construction or work thereon and to ensure the proper protection of fish life, secure the written approval of the department (of fish and wildlife) as to the adequacy of the means proposed for the protection of fish life," "Bed" means the land below the ordinary high water line of state waters, The "ordinary high water line" is the mark on the shores of all waters that will be found by examining the bed and banks and ascertaining where the presence and action of water is so common and usual and so long continued in ordinary years, as to mark upon the soil' or vegetation a character distinct from the abutting upland, The e-mail received today from Candace Cramer from Parametrix states that all proposed work would be landward ofthe ordinary high water line (OHWL), If work conducted landward of the OHWL doesn't impact the water of the state (i,e, water quality) or affect the natural rate of sediment delivery to the beach from either impoundment behind a structure or increased erosion, a Hydraulic Project Approval (HP A; RCW 77,55, WAC 220-110) to be issued by WDFW will not be required for the project. ,.,_~-L;;dK,_",__.
