In response to the GMA and Regulatory Reform and upon completion and adoption of the Port Ludlow Development Program (FEIS dated April 1993)....on June 14, 1993, the DoE issued Shoreline Conditional Use Permit #1993-14647 (Jefferson County Substantial Permit SDP#91-017). That permit approved the construction of a 36 room hotel, 5 single family residences, 53-multi-family residences, 367 parking spaces, etc....! called to verify and according to WDFW doctrine, since we already have the required shoreline permits, no additional permits are required (ie, JARP A/HP A) as long as the continued work "does not involve over-water construction AND is located landward of the OHWM". Our continued construction of townhomes and associated improvements within the approved Final Plat of Ludlow Bay Village (recorded 5/24/94 - Vol 6, Page 228 to 233) appears to be in compliance without any additional permits required. In regards to your concern about shoreline setbacks for the current townhomes under construction and the next units scheduled, the building setbacks within the approved Final Plat of Ludlow Bay Village is 30-ft from "The line of OHWM per RCW 90.58.030 as established by Jim Pearson of Jefferson County on November 6, 1991 and field located by Traid Associates". Since the OHWM was found, that is in fact our setback parameter. It is only MHHW "if" the OHWM cannot be found. Hello Kevin and Mark, Mark and I just discussed the grading and proposed development plans for the lagoon as well as proposed home development along the shoreline to the north and east. To reiterate, I will need to see the applications (preferably in the form of a JARP A) for all of these prior to beginning construction. Based on review, an HPA may be needed. As you know, the HP A is a separate permit from the county process. WDFW, not the county, determines when an HP A is needed. The CoB may also be involved for development over the lagoon, which is saltwater. I'll be by the site on Monday afternoon and look forward to the plans. JAS. Dr clj:t a 2
