After further consideration, I think I need to add the following to our thought process. The PLA is proposing a plat alteration, but the plat alteration DOES NOT violate any covenants if PLA is resubdividing land it owns. In the absence of any restrictive covenants being violated, the signatures of all owners are not needed. Thus I agree with Davis Wright Tremaine and not Farady of Foster Pepper. The application for the plat alteration will be governed by RCW 58.17.215 and because of the 2000 Development Agreement with the then owner (ORM) the MPR Code, L.U.P.O. and the 1992 Subdivision Ordinance. Please confirm that I least have the right ordinances. You will need to answer in your own mind two questions. 1. Is what PLA is proposing a plat alteration 2. If it is a plat alteration, then what does PLA as the applicant have to do?
