I wanted to call your attention personally to three questions raised in the summary of our statement that are not strictly related to scoping of the EIS. ( 1) Can the lot designations stipulated in the 1993 approved plan for the Ludlow Bay Village developnent be changed without further County approval? (2) Are certain of the platted lots in Ludlow Bay Village that lie partially within the lagoon actually buildable lots? If buildable, is permission required from the Department of Ecology, Fish and Wildlife, or other responsible environmental agencies? ( 3) Can the Port Ludlow conmuni ty be assured that Jefferson County will fi.nally enforce the conditions that were set down in the 1993 Shoreline Substantial Developnent permit and will the County monitor and insist on compliance with any new conditions imposed upon the current proposal? We would very much appreciate it if your Department could research these questions and provide us with timely answers. Once staff has had an opportunity to complete its review, we will provide the mylar for signatures. To facilitate the review process, I have prepared brief comments and exhibits as documentation in response to (a) the Shoreline Permit, (b) Preliminary Plat Conditions, (c) mitigations for the "Inn" Project EIS, (d) mitigations for the Programmatic EIS, and (e) BCC Findings and Conclusions 9/13/93 Relative to School and Fire Issues. Since there is considerable overlap and repetition in the required mitigations/conditions, responses are cross referenced. Hopefully these comments will serve as a "road map" in helping you find what you need to recommend approval of this project. The foregoing should complete the requirement for final plat submittal. Prior to recording, we will submit the updated title certificate, the final CCRs, and payment of any additional fees for inspections and processing billed by the County. Timing of various components of construction may vary somewhat depending on weather and site conditions. Daily site inspection and continuing coordination with Public Works will determine appropriate timing of construction. In addition to notation of undisturbed vegetation shown on the Landscape Plan, the areas are delineated on-site with survey tape and/ or silt fencing as indicating of "limits of grading." Grading stockpiles and staging areas are noted on the erosion control plan. Dredge material is suitable for fill, but not for road construction.
