Re: Public Records request dated August 23, 2004.
Dear Mr. Gendler:
Your office sent two letters dated August 23,2004, one of two pages and
another single-page letter. Reading them together I understand them to be a Public
Records request for communications that have occurred between County staff and
Port Ludlow Associates (with either party as the sender or recipient) since July 1,
2004. This office cannot respond to the request for copies of any permit
applications since July 1 because DCD and not this office would have such
documents. Please advise me immediately if I have misconstrued the Public
Records requests of August 23.
Enclosed are 85 pages of documents, Bates stamped 001-085, that are
responsive to your Public Records request. They include any e-mail 'strings' or
'chains' if anyone of the e-mails in that 'chain' went to a Port Ludlow Associates
("PLA") employee from the County or vice-versa.
Separately, the attorney for PLA has used the same Public Records Act to
request copies of any documents such as memos, correspondence or e-mails that
relate to land use development proposed or applied for by PLA in the Port Ludlow
Master Planned Resort. See pages 48 & 49 of what has been supplied with this
letter. Thus, the same 85 pages are being supplied to PLA.

Finally, Les Powers has previously made a Public Records Act request
similar to that made by Mr. Gendler and is therefore also entitled to these same 85
pages. By copy of this letter Mr. Powers is receiving the 85 pages.
Of course, the fact that this letter is going to PLA from the County makes this
letter itself a document that is responsive to the three Public Records requests
described above, a small irony.
Mr. Gendler, PLA and Les Powers must all submit a check payable to the
"Jefferson County Treasurer" in the amount of$12.75 to cover the cost of these
copies at $.15 per copy.
Other departments of the County may have other documents that are
responsive to these three similar Public Records requests. This office is NOT
coordinating the response of any other County offices or departments.
