This Department will consider this information when and if a land use application is made by the landowner in the future. I do not completely understand the distinctions you have arrived at in concluding that the lagoon area is a shoreline, but is not a wetland. If it is not a wetland, then which category of shoreline does it fall into? Additionally, you did not explain the rationale behind the changing of your department's position froin June 14,1993 when Ecology approved (in writing) a Shoreline Conditional Use permit (SDP91-OO17) for the Ludlow Bay Village Plat that included over-water construction. Nor did you apparently consider the impacts of yourconc1usion upon the build out of the plat of Ludlow Bay Village. Imagine the number of landowner's we would be dealing with if all the lots were in individual ownership rather than being owned by one entity. This letter confirms that I will be attending a pre-application meeting in Olympia on November 18, 2004 to examine various alternatives regarding the lagoon and the above-mentioned plat. I look forward to a continued discussion of these issues and the resolution of this matter.
