The roadway setback issues are not as Jefferson County appears to believe decorative. I refer to the engineering report accompanying my comments and Mr. Stevens' engineering report to the FSEIS on the proposed major revision to the resort plan. I further understand that the former fire chief has privately indicated that the fire department is not able to fight beach side fires, i.e. grass fires, in the townhouse subdivisions. This is a result of a combination of Jefferson County's approval of unsafe road design and building design conditions that have yet to be corrected. I further draw your attention to the SDP 91-017 and the developer's construction of twelve townhouse units after the lapse of construction privilege thereon in violation of the SMA and the Program. I further draw your attention to the developer's construction of townhouse units on the roadway setback at buildings 400 and 700 in violation of the MPR Zoning Code and, as to building 700, the building permit. The justification that you articulated for instructing your inspectors to overlook the setback because of the preliminary site plan is incorrect. The preliminary site plan that you sent me for building 700 to justify this position describes the areas now covered by garages and living area as driveways. Driveways would have qualified. Garages and living areas did not and do not. These matters remain unattended by Jefferson County despite my demands upon Jefferson County and the developer that they be corrected. I finally note the failure of the developer and its predecessor to follow SDP 91-017 and the landscape plan associated therewith in landscaping the lagoon and its curtelage and the failure thereof to maintain water and habitat quality of the lagoon and its curtelage as required by SDP 91-017 and the continued failure of Jefferson County to require the developer or its predecessor to come into compliance with SDP 91-017 with respect thereto. In an open hearing, Ms. Lumsden responded to an inquiry by the ARE about my allegation of violations, with the response that they should be ignored in connection with future land use decisions at Ludlow Bay. I strongly dissent this view. I will elaborate my comments on the proposal of the developer by subsequent letter. Please include these preliminary comments in the file.
