The developer, PLA, has the right to finish build-out of this complex for which a permit was issued in 1993 to build 53 townhouses and five single family residences. The proposal before the CDC would dramatically alter that permit and result in unacceptable higher density and a change in character of this specific community. The developer wishes through means of a boundary line adjustment to increase the number of residences by more than 50% and to convert ownership from townhomes to condominiums. While the law recognizes the use of the boundary line adjustment in certain limited instances, the present proposal is clearly not such a permissable instance. It appears that PLA has elected to submit a "wish list" in lieu of an application intended to meet the requirements of law and the desires of the community. The CDC has the opportunity to preserve a unique portion of this county while still permitting reasonable development as defined and articulated in the earlier permit. In soing so, the CDC will require that PLA adhere both to the spirit and the letter of the law. Thank you for your thoughtful consideration of this request.
