I can't find any code guidance for a pre hearing conference prior to a open record hearing. I do see such
guidance for a pre hearing conference before a closed record appeal. Check the LUpa.
The Ap Ex repeal recommendation for the UDC is before the BaCC on Jan 9 at 10 am for a public hearing. The
Ap Ex repeal from the Pt Ludlow LUpa is not part of this amendment package.
I'm off Thurs and Friday of this week. I'll be here during the week after Christmas.

I would not like to see such a pre-hearing conference because there are many more parties to the
resort buildout than merely the applicant and the county. I agree with Irv that it would be better
to hold such a pre-hearing admin conference at a time and date correctly noticed and publicized
for the public to watch and participate if needed.
As for pre-hearing rules, we already have the rules set out in the LUPO and LUAP for hearings.
The BoCC did nothing with the decision of AHE Galt, as the decision of the AHE is, in some
regards, their decision. Other parties will have to decide what to do with it.

The participants that you suggest would probably constitute ex parte
communication.
Part of my problem right now is that I only know about the topics listed in the
advertised notice. Plus, the Major Resort Plan Revision is a new type of case--
obviously controversial or of interest to many.
In terms of timing, I was thinking that the Jan 17 day could be used for a structured
pre-hearing administrative conference (without testimony). An alternative could be

a pre-hearing set of rules distributed to known parties of interest.
I am copying this email to David Alvarez to stimulate his thoughts. We can revisit
the subject after Christmas (I am taking a few days of "vacation" now).
By the way, what did the BOCC do with the Appellate Examiner repeal?

Al has informed me that you desire to hold a pre-conference hearing on the Resort Buildout
applications at Ludlow Bay Village. Do have a day and time in mind and do you prefer to
conduct it via conference call or in person?

Al Scalf, Marco, Mark Dorsey (and whomever he might bring) and myself.
