The most problematic issue is PLA's assertion that this is a boundary line adjustment. It is clear that boundary line adjustments are allowed for administrative corrections and minor adjustments within a plat. What PLA is proposing is a wholesale change in the plat but using the a BLA to avoid the provisions of the RCW that requires approval of ALL owners in a covenanted community. In this case, the town home plat has 53 Lots, with 25 having been built on and sold and 28 owned by PLA. The covenants contain many restrictions and conditions which will be violated if PLA is allowed to replat the 28 Lots. As just a couple of examples, the area is now single family residential. What they are proposing is multifamily condominiums. Further, the CCR's require PLA to subsidize the financial operations of the association until 40 homes have been sold, which will become impossible if this BLA is approved. Lastly, based on the state condominium law they are, while technically reducing the number of lots, are increasing the number of parcels which disqualifies this as a BLA. For full details see log item 277. PLA knows this action is not a BLA. I refer to log item 66, a letter from Mark Dorsey at PLA to AI Scalf at DCD. In this letter Mr.Dorsey states, "PLA agrees that an alteration to the plat of Ludlow Bay Village is required to implement the proposed 2003 Resort Plan and intends to pursue this action as requested by Jefferson County". just think their lawyers got clever and decided if they obfiscated the reality by reducing the number of lots they could push this through. Common sense dictates that this is not a minor adminstrative revision. They are doubling the density and changing the use from single to multi family. Thanks you for your consideration.
