REGARDING ADOPTION OF STATE BUILDING CODE ACT
NOTICE IS HEREBY GIVEN that the Jefferson County Board of Commissioners
will conduct a public hearing at 10:30 a. m., Monday, December 23, 1974, in the
Commission Chambers, Jefferson County Courthouse, Port Townsend, Washington, for
the purpose of obtaining the comments of all interested persons on the proposed
ordinance adopting as modified the Uniform Building, Plumbing, Fire and Mechanical
Codes, which reads as follows:

WHEREAS, the state legislature has enacted the- State. Building Code Act,
Chapter 96, Laws of 1974, First Extraordinary Session, adopting the Uniform
Building, Plumbing, Fire and Mechanical Codes, and
WHEREAS, the State Building Code is intended to eliminate restrictive,
obsolete, conflicting, duplicating and unnecessary regulations and requirements
which could unnecessarily increase construction costs or retard the use of new
materials and methods of installation or provide unwarranted preferential treat-
ment to types or classes of materials or products or methods of construction;
and to provide for standards and specifications for making buildings and
facilities accessible to and useable by physically handicapped persons; and
WHEREAS, the State Building Code Act is intended to consolidate within
each authorized enforcement jurisdiction, the administration and enforcement of
building codes, and WHEREAS, RCW 36.32.120 provides that the Board of County
Commissioners shall have the power to "make and enforce, by appropriate
resolutions or ordinances, all such police and sanitary regulations as are not
in conflict with state law, and within the unincorporated area of the county
may adopt by reference Washington State statutes and recognized codes and/or
compilations printed in book form relating to the construction of buildings,
the installation of plumbing, the installation of electric wiring, health, or
other subjects, and may adopt by reference such codes and/or compilations or
portions thereof, together with amendments thereto," with certain procedural

provisions enumerated in the said section:
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
JEFFERSON COUNTY, WASHINGTON, as follows:
Section 1. Building Code. There is hereby adopted by the Board of
County Commissioners of Jefferson County, Washington, in conformance with
the State Building Code Act, the following codes:
(A) Uniform Building Code and Related Standards, 1973 edition, published
by the International Conference of Building Officials; except as follows:
(i) Compliance with the provisions of this code shall not
be required of Group J Occupancy.
(ii) That a new catagory of occupancy group designated
"Group K Occupancy" is hereby established. Group K
Occupancy shall include all factory built mobile and
modular homes.
Group K. Occupancy:
(1) Shall comply with all applicable state
structural codes, including but not limited
to the provisions of Chapter 43.22 RCW, and
(2) Shall be attached to a fixed foundation.
(iii) That a new catagory of occupancy group designated
"Group L Occupancy" is hereby established. Group L
Occupancy shall include those bulkheads, docks, and
similar shore -related structures which require a
Substantial Development Permit under the Shoreline
Management Act of 1971, Chapter 90.58 RCW. All
structures within Group L Occupancy shall be designed
by a professional engineer licensed to practice in
the State of Washington and two sets of the -plan shall
accompany each application for a building permit.
(iv) Chapter 3, 301 (c) is hereby amended to read as follows:
Plans and Specifications. Except for Group I
and K Occupancies, with each application for a
building permit, and when required by the Building

Official for enforcement of any provisions of this
Code, two sets of plans and specifications shall
be submitted. The Building Official may require
plans and specifications to be prepared and
designed by an engineer or architect licensed
by the state to practice as such.
(v) With each application for a building permit of Group I
Occupancy the following are required:
(1) A thorough written description of materials
and construction methods;
(2) A plat plan, drawn to scale, showing the
location of the proposed structures by dimensions
from property lines to the walls of the structure;
and
(3) A foundation plan, drawn to scale, showing
spacing and size of supporting walls and piers
or ports..
(vi) Chapter 3, 303 (a) ITable No. 3-A - Building Permit Feesj
is hereby amended by adding to the established schedule
the following:
For all Group K Occupancy applications, a fee of
Twenty Dollars ($20) is established.
(B) Uniform Mechanical Code, 1973 edition, published by the International
Conference of Building Officials and the International Association of Plumbing
and Mechanical Officials.
(C) The Uniform Fire Code with appendices thereto, 1.973 edition, published
by the International Conference of Building Officials and the. Western Fire
Chief's Association.
(D) The Uniform Plumbing Code, 1973 edition, published by the International
Association of Plumbing and Mechanical Officials:
PROVIDED, that Chapter 11 of such code is not adopted: PROVIDED, that notwith-
standing any, wording in this code, nothing in this code shall apply to the

installation of any gas piping water heaters, or vents for water heaters; and
(E) The American National Standard Specifications for Making Buildings and
Facilities Accessible to, and Useable by, the Physically Handicapped, published
by the American National Standards Institute, Incorporated, Document
ANSI A117.1-1961 (reaffirmed 1971).
In case of conflict among the codes enumerated in Section 1, (A), (B),
(C), (D), and (E) of this ordinance, the first named code shall govern over
those following, save and except such portions as are hereinafter by this

deleted, modified, or amended, of which said codes, three copies
have been filed in the Jefferson County Auditor's Office and said codes are
hereby adopted and incorporated as fully as if set out at length -here -in, and

from the effective date of this men the provisions thereof shall be
controlling within the unincorporated areas of Jefferson County.
Section 6. In conformity with the provisions of the State Building
Code and Chapter 29.34, Interlocal Cooperation Act, Jefferson County, upon
proper procedure delineated under RCW 36,22.120 (powers of board), may
provide for administration and enforcement of the State Building Code within
its jurisdictional boundaries by establishing a local building department.
Such administration and enforcement of the State Building Code by its building
department shall include all of the codes comprising the State Building Code
as enumerated in the previous section.
Section 8. Should any section, paragraph, sentence or work of this
Reso-ltea or of the codes hereby adopted be declared for any reason to
be invalid, it is the intent of the Board of County Commissioners that it would

adopted, independent of the elimination herefrom of any such portion as may
be declared invalid, and accordingly, such. declaration of invalidity shall

Gentlemen:
With respect to the Above -referenced subject matter, the Jefferson
County Planning Commission and Planning Department recommend the follow-
ing:
I. CODE CONTENT AND IMPLFA NTATION:
- The Jefferson County Building, Plumbing and Mechanical Codes should
apply to all structures in Occupancy Groups A through I inclusive.
- The Building, Plumbing, and Mechanical Codes should apply to Group
J, Division 1 Occupancies except sheds, carports, and agricultural
buildings less than 1000 square feet in area. The same codes should
apply to Group J, Division 2 Occupancies (fences over 6 feet high,
tanks, and towers). The same codew should not apply to Group J,
Division 3 Occupancies (agricultural buildings over 1000 square feet
in area).
- The Uniform Building, Plumbing, and Mechanical Codes should apply to
Group A through I Occupancies and those portions of Group J Occupan-
cies noted above, regardless of Building Type.
- A group K Occupancy should be established for mobile and modular homes
constructed in compliance with applicable state structural codes (R.C.W.
43.22.340 through R.C.W. 43.22485).
The basic requirements for Group K Occupancies should be:
A. Compliance with state codes for such structures, and
B. Attachment to fixed foundation or adequate tie -downs approved
by the Building Official.
- A Group L Occupancy should be established for docks, piers, wharves,
bulkheads and similar shoreline -oriented structures. The Shoreline
Management Advisory Committee should be consulted with respect to
recommendations for basic requirements.
- The Uniform Fire Code should apply to all structures in Jefferson
County.
- The entire unincorporated area of Jefferson County should be designated
a Fire Zone 3 so as to provide the least amount of restriction on the
types of buildings that can be erected in the County.
- U.B.C. Chapter 504, Section A, Paragraph 2 should be revised to read,
"For the purpose of this Section, the right-of-way line of an adjoining
street or alley shall be considered an adjacent property line".

II. CODE IUMINISTRATION:
- The purpose of the Building Department should be to serve as a
technical consultant for people building their own structures as
well as a code enforcement agency.
- The Building Official should act as administrator for all four
codes that must be adopted.
- To the extent possible, the building permit administration system
should include other land development permits such as road -access
and septic tank permits.
- The Building Department should be as financially self-supporting
as possible and as a guide the budget should not exceed the antic-
ipated revenue by 20%.
- Structural plans should be required for all Occupancy Groups with
the exception of Group I Occupancies defined as "Dwellings" (single-
family and duplexes); Group J Occupancies not otherwise exelApt;
Group K Occupancies; and Group L Occupancies.
However, for Group I, J, and L Occupancies a thorough written
description of materials and construction methods should be sub-
mitted and accompanied by: (1) a plat plan, drawn to scale, showing
the location of proposed structures br-dimensions from property lines
to the walls of the structures, (2) a foundation plan, drawn to scale,
showing spacing and size of supporting walls and piers or posts.
- With respect to permit application fees:
An analysis sf every building permit issued by Jefferson County
and the City of Port Townsend in 1974 reveals that if the tvw juris-
dictions had used the minumum fee schedule in the U.B.C., and had
charged a flat rate of $20 permmobile home -setting, the gross annual
income from permit fees would have been $28,776.
Because the concept of a financially self-sufficient Building
Department is desirable, based upon the foregoing analysis the fee
schedule for the Jefferson County Building Code should be that out-
lined in the U.B.C. plus a flat -fee of $20 for each mobile home to
be newly sited.
III. LEGAL MA.TTEIIS:
We further suggest that before any of the foregoing recommenda-
tions are adopted, that the Jefferson County Prosecutors Office review
the recommendations and codes in detail with respect to legal implica-
tions.
Furthermore, we suggest that any contractual arrangements between
Jefferson County and the City of Port Townsend with respect to coopera-
tion in administration, budgets, hiring of personnel, etc. be under-
taken without delay. The same should apply to any similar arrangements
with Clallam or Grays Harbor County.

Re: Hearing for adoption of
State bldg. code ordinance
Gentlemen; Representing a minority view of the planning commission, I would
like to read into the proceedings of this hearing, a statement of part of my and
ourposition in regard to the bldg. code ordinance.
1. The State Bldg. Code Law allows the county to exempt any classification
or type bldg it deems advisable. Therefore I want it clearly understood by all
that if we apply the UniformBldg. Code to buildings in this county it is because
the county commissioners want it to apply to those buildings. The State doesnI t
tell us what to apply it to, we do that on a county basis.
2. There is feeling that the bldg. code and bldg. inspector will prevent junky
communities and houses. This is no more true
than that an inspector can enforce Quality of workmanship. Safety and quality
of matetial is the extent of services. I donIt believe it has to be that way but
I am told that that is the way it is and will be. Galvanized metal roof and
siding would satisfy the code for houses. I guess a dirt floor would be OK but
you must have a bathroom with fixtures and running wa-°ter. I know people who want
to build a house and use an outhouse because they have no electricity. T'm not
sure yet whether the inspector or the county are allowed to make exceptions to the
code in this type item.
3. Three members,at least , of the planning commission including myself
believe we do not need to include Occupancy Group I, private dwellings.There are
reasons jtt to include it but do we have to have a completely regulated society?
Also I have just comprehended a couple reasons for exempting Class I that I hadn't
previously understood.
One being that Chap. 2 sets down the rules and powers of the bldg. inspector;__
right to enter on demand, powers of a police officer, to mention a couple. Sec202a
I guess this chapter is not exemptable or amendable except to use it as a minimum.
The only way to protect ourselves from this chap. is to exempt Class? from our ordinance.
Another reason being the application of the code. Sec. 103 of the code says
it shall apply to construction, alteration,moving, demolition,.repair, and mainten-
ance of any value, whether by owner or .-Thoever.. I dont kno.,T if this section is
exemptable. Possibly we could exempt the type building that required repair to a
specified value limitation. I don't believe this�the type exemption referred to
in sec 6 para -3 but T haven't had time to study this type amendment or exemption.
,,re could limit its application by exempting the class T occupancy group.
Sec.205 lists violations and penalties- any violation is punishable by a fine
of $300 and imprisonment for 90 days for each offense and each day a separate
offense. _
?•,'e have not made a study or even an estimate of ??hat a code house sill cost in
relation to a normal uncode house- several hundred dollars at least and maybe as
much as x;2.000.
This statement is not the planning commission recommendation. T no longer concur
in it in the above mentioned areas. You have it in hand. This is my statement
and a lot of it is based on information. I have discovered since the planning commission
recommendation was formulated.
T respectfully request thatthe aforementioned points be given consideration
and regret that I have not had the time to carefully consider all of the above as
well as the complete code before the commission :Wade its recommendation.
