ORDINANCE NO. 1- J~
AN ORDINANCE of Jefferson County relating to the issuance of
permits for the construction of approaches to
county roads and providing a penalty.
WHEREAS, the Board of County Commissioners for Jefferson
County, Washington, deems it necessary and in the public interest
to provide for the issuance of permits as authorized under the
provisions of R.C.W. 36.75.120 et seq., now, therefore
BE IT ORDAINED by said Board of County Commissioners as
follows:
Section 1. No person, firm or corporation shall after
the effective date of this ordinance build or construct any
approach to any county road without first obtaining a written
permit so to do.
Section 2. Applications for approach permits will be
filed in the office of the County Engineer upon forms furnished
by that office reflecting on the face thereof the following:
(a) a minimum approach angle of 70 degrees;
(b) on county road cut sections or shallow fills
standard culvert pipe in not less than 21 feet
in length and 12-inch diameter will be required;
(c) a four-inch gravel course on the approach is
necessary to prevent tracking onto county roadway;
(d) a maximum grade of minus 2% or plus 2% for 20 feet
back of shoulder line will be permitted;
(e) no grading or distortion of county road shoulder
is allowed;
(f) a stopping site distance is required, i.e. where
the county road is posted to 60 MPH, a distance
of 475 feet; where the county road is posted to
40 MPH, a distance of 275 feet;

Section 3. An endorsement of approval by the County
Engineer on the face of the application shall be deemed the
PERMIT as contemplated by this ordinance.
Section 4. Any person, firm or corporation found to be
in violation hereof shall be subject to a penalty of not to
exceed $100.00, as may be imposed by the Jefferson County Dis-
trict Court.
Section 5. That this ordinance shall be in force and
take effect August 10, 1972.

NOTICE OF TIME AND PLACE OF HEARING
FOR ADOPTION OF PROPOSED ORDINANCE
NOTICE IS HEREBY GIVEN that on Monday, the 7th day
of August, 1972, at the hour of 10:00 o'clock in the fore-
noon of said day at the County Commissioners' room in the
Jefferson County Courthouse, Port Townsend, Washington, the
Board of County Commissioners for Jefferson County will take
up for consideration the adoption of a proposed ordinance,
which said ordinance is in words and figures following, to-
wit:

In compliance with your request, there is attached
hereto the form of a proposed Ordinance to meet the re-
quest of the County Engineer.
You will note a change in the customary language
heretofore used in the nature of an enforcement clause.
In keeping with the modern trend to remove from ordinances,
merely regulatory in scope" the words "offense" and "im-
prisonment" have been omitted, and the word "penalty"
substituted.
