ORDINANCE No. / - ?/ 1 AN ORDINANCE of Jefferson County, State of Washington, repealing Ordinance No. XII adopted by the Board of County 2 Commissioners for Jefferson County May 11, 1956. ^~., 3 4 WHEREAS, it appears to th is Board of Co un ty 5 Commissioners that the language embraced in Jefferson County 6 Ordinance No. XII, adopted May 11, 1956, is vague, undefined 7 and ambiguous and enforcement thereot thus unsatisfactory from 8 an administrative viewpoint, therefore, 9 BE IT ORDAINED as follows: 10 Section 1. That Jefferson County Ordinance No. XII, adopted May 11, 1956, and the whole thereof, be and the same is hereby repealed. 11 12 13 14 Section 2. WAC 248-73-010 Purpose. The foliowing rules and regulations are establi~hed as the minimum sanitation requirements for outdoor music festivals. in accordance with chapter 302. Laws of 1971 ex. sess. (Order 59. ~ 2411-73-O10. filed 8/16/71.] ~ \. WAC 248-73-020 Definitions. (I) "Outdoor Music Festival" or "M usic Festival" or "Festival" means an assembly of persons gathered primarily for outdoor. live. or recorded music entertainment. where the predicted attendance is 2.000 or more and where the duration of the program is five hours or longer: Provided. That this definition shall not be applied to any regularly estab- lished permanent place of worship. athletic stadium. athletic field. arena. auditorium. coliseum. or other sim- ilar permanently established places of assemblies which do not exceed b\" more than 250 people the maximum seating capacity'of the structure where the assembly is held: Prol'idcd. further. That this definition shall not ap- ply to government sponsored fairs held on regularly es- tablished fairgrounds nor to assemblies required to be licensed under other laws or regulations of the state. (2) "Local Health Officer" means the legally quali- fied physician who has been appointed as the health of- ficer of the city. town. county or district public health department as defined in RCW 70.05.010(2), or his authorized representative. (3) "Applicant" means the promoter who has the right of control of the conduct of an outdoor music fes- tival who applies to the appropriate legislative authority for a license to hold an outdoor music festival. The appli- \:ant shall submit plans for site and development to the local health officer not less than 30 da)s prior to the (5/1/79) time the applicant must file his application with the is- suing authority. The plan shall include the name of the festival, its physical location, dates of operation. the name, address and phone number of the applicant, a list of other individuals responsible for all phases of con- struction and operation, and shall include the following information: ( I) Projected allendance at the outdoor music festival. (a) Maximum day :lttendanee. (b) Maximum overnight attendance. (c) Total attendance for the duration of the festival. (2) Sitc characteristics: (a) The area, dimensions, legal description and own- ership of the tract of land. (b) Physical ~haracteristics of the site, including but not limited to bodies of water, existing structures, topo- graphical data, current land use of site and contiguous property. (c) Location. and the width of all offsite access roads and onsite service roads. (d) Location of facilities including parking, camping sites, food concessions, medical services, entertainment area, water source and distribution system, sewage dis- posal, solid waste collection and disposal, bathing areas, communication facilities and administrative accommodations. (3) Method and design of water supply and distribu- tion system. (4) Method and design of sewage and waste water collection and disposal systems. (5) Method and design of toilet facilities, their num- ber and location. (6) Method of solid waste collection and disposal, in- cluding number and location of containers. (7) Method of insect and rodent control. (8) Design of food service facilities and information including source, storage, preparation and types of foods. (9) Design and location of all facilities providing shel- ter including overnight accommodations for festival patrons. (10) Method of dust control. ( II) Plan of electrical service, including type, location and number of lighting fixtures. communications facili- ties and electrical outlets. (12) Description of bathing areas and facilities. (13) Transportation and facilities for emergency med- ical service. No later than fifteen days after the submission of plans for site and development. the local health officer shall either approve or disapprove such 'plans. Any dis- approval shall set forth in detail the specific grounds therefor. The applicant shall have an opportunity to cor- rect the deficiencies as described by the local health of- ficer and to resubmit plans for local health officer ICb. 248-73 WAC--Jl1) 01.0255.002331 ",- <; 248-73-030 Outdoor Music Festhals ( approval. Final approval or disapproval shall be given by tile local health officer on or before the date set for sub- mission of application to the issuing authority. The festival site shall be well drained. located and maintained so as not to crcate a health or safety hazard or nuisancc. [Ordcr 59, ~ 248- 73-040. filed 8/16/71.] WAC 248-73-050 Water supply. (I) A supply of water shall be provided from a source approved by the local health officer. (2) The water shall comply with the standards for quality as specificd in WAC 248-54-430. (3) The water supply shall bc provided through a dis- tribution system. capable of maintaining a minimum pressure of 10 pounds per square inch at all times. or by an alternative method acceptable to thc local health officer. (4) Water supply outlets shall be provided in a mini- mum ratio of one outlet for every 200 pcrsons. and lo- cated within 300 feet of all portions of all day use and overnight camping areas. (5) All components of the distribution system shall be disinfected prior to initial use in accordance with WAC 248-54-390. (6) Common drinking container shall be prohibited. All sewage and liquid wastes shall be disposed of in a manner approved by the local health officer and shall comply with WAC 248-50-080 through 248-50-110. [Order 59. ~ 248-73- 060. filed 8/16/71.] \\' AC 248-73-070 Toilet facilities. (I) There shall be provided separate toilet facilities for each sex. Such toilets shall consist of adequately designed and main- tained privies. chemical toilets or other facilities for the collection and disposal of human wastes. as may be ap- proved by the local hcalth officer. (2) A minimum number of three toilets for each sex shall be provided for the first five hundred patrons and one additional toilet for each sex shall be provided for each additional five hundred patrons or major fraction thereof. The total number of toilets shall be based on the projected maximum daily attendance. (3) Toilet facilities shall be located within 300 fect of all portions of all day use and overnight camping areas. In addition. there shall be toilets immediately adjacent to food concessions. medical ~ervicc and administrative areas. (4) Toilet facilities shall be constructed in a manner to provide privacy and to facilitatc c1caning and mainte- nance. Toilets shall be kept clean and free of insects, ro- dents and excessive odors. lOa. 2..s-73 WAC-1' 21 (5) An adequate quantity of toilet papcr shall be pro.. vided. (I) All s~lid waste. including but not limitect to garbage. trash. and other refusc. shall be collected. transported and disposed of in a manncr approvcd by the local health officcr and shall comply with WAC 248-50-120. (2), An adequate number of convcniently located con- tainers. approved by the local health officer. shall be provided in all activity areas. (3) All solid waste shall be collected at sufficicnt in- tervals to prevent nuisances or public health hazards. (4) All solid waste collected from food service and medical service areas shall be stored in clean watertight containers with tight fitting lids. Food service facili- ties shall be operated and maintained in accordance with the provisions of chapters 248-84. 248-86 and 248-87 WAC. Special control measures such as watering. oiling. sawdust or application of other soil stabilizers shall be made at food conces- sions, and medical service facilities. (I) Outside lighting shall be provided for spectator and parking areas, toilet facilities, food concessions. medical service facilities and walkways. (2) Light measured on working surfaces inside medi- cal service facilities and food concessions shall be at least 20 foot candles. (I) The applicant or his designated agent shall familiarize himself with these regulations and shall maintain the festival site and facil- ities in a clean and sanitary condition. The applicant or his designated agent shall be on the site at all times and shall be responsible for the operation of the festival and compliance with these rules and regulations. Department of Social and Health Services. may waive. modify. or approve reasonable alternatives to any of the requirements of these regulations. Since the February 1 meeting, I have checked the files of the Port Townsend Leader and find that that particular Ordinance was adopted after a return day duly fixed and published. However, again since February 1, Mr. O'Meara had an opportunity to read Ordinance No. 12 in detail and I am sure that he is not satisfied with the same. :0.WU7 w. J. III WHEREAS, it appears that ,coin operated amusement devices are being owned and operated through Jetferson County, outside the limits of incor- porated ci tie s and towns and wi thin the same; and . ~ WHEREAS, it is necessary and proper that supervision and regulation be exercised over said amusement devices in the regulation and auperviaion . of which it will be necessary to incur certain expenses; and '. WHEREAS, it is necessary to the peace and safety of Jefferson County that the same be very carefully supervised. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Jefferson County, Washington, pursuant to the police powers inhet-ent in said Board, to protect the peace and safety of all the individuals within its jurisdiction, as fo~lows: Section 1: From and after the 11th day ot May 1956, no amusement , games, including music machines, all coin operated machines, except radios and televisions, shall be operated or kept for operation in Jefferson County unless licenses for the operation thereot have been taken out as hereinafter provided, and provided that the same shall have been licensed by the Tax , , Commission of' the State of Washington../" \ Section 2: Any person, firm or corporation desiring to own, maintain and operate any suc~ coin operated amusement devices shall make written application tor an Operator's license so to do, and file the same with the Board of County Commissioners for its ,~pproval or rejection'.
