ORDINANCE NO. X.
RELATING to the issuance of permits for the construction or alteration
of buildings or structures; providing for fees therefor; providing
for exceptions; and'for transmittals of copies of such permits to
the county assessor.
BE IT ORDAINED BY THE COUNTY COMMISSIONERS OF JEFFERSON COU NTY AS FOLLOWS:
Section 1. No person, firm or corporation shall hereafter erect,
construct, enlarge, shore, underpin, repair, improve, convert, or otherwise
alter any building or structure in this county for which the value of the
materials exceeds five hundred dollars without first obtaining a separate
building permit for each such building or structure from the county Auditor;
Provided, That there shall be exempted from the requirements of this
ordinance buildings or structures lying within any incorporated city or
town within this County which already requires such permits.
Section 2. To obtain a permit the applicant shall fill out a blank
permit form to be supplied by the county Auditor. The applicant shall
in.clude thereon:

The permittee's name and address.
A legal description of the property on which the build-
ing or structure is located or will be located.
A general description of the nature of the proposed work.
The estimated value of the materials to be used in the
proposed work.
The permit form may be signed by the permittee, or his authorized agent
who may be required to submit evidence to indicate such authority.
Section 3. Prior to issuance of the permit the accuracy of the legal
description included thereon Shall be verified by the county Auditor. Upon
payment of a fee of one dollar the county Auditor shall sign the permit
and shall issue the original thereof to the applicant.
Section 4. The County Auditor shall promptly transmit a copy of the
permit to the county assessor, and shall also transmit a copy to the county
engi neer.
Section, 5. If any section or portion of this ordinance is for any
reason held invalid or unconstitutional by any court of competent juris-
diction, such section or portion shall be deemed a separate provision of
this ordinance and such holding shall not affect the validity of the
remaining portions of this ordinance.
Section 6. All ordi nances or parts of ordi naIlces inconsi stent or in
conflict herewith are hereby repealed.
Section 7. This ordinance shall take effect June 9, 1955.

Gentlemen:
Chapter 129, Laws of 1955 (Senate Bill 228), reads in part: liThe
County Commissioners of every county shall provide' for the issuance of
a building permit for the construction or alteration of any building within
the county for which the value of the mate'rial exce'eds five hundred dol-
lars, except that where any city within the county issues such pe-J.:mits
for all buildings within its jurisdiction, it shall not be necessary lor the'
county to issue building permits for the construction or alteration of build-
ings within such city. Every application for a building permit al;; required
herein shall contain a legal description of the property upon which the
building is to be constructed or altered.
"Whenever any issuer issues a building permit for the conS1i!uchon
of any building, such issuer shall immediately transmit a copy of the, per-
mit to the county assessor of the county ln which such building is to be
constructed. II
Enclosed herewith are a proposed ordinance and a proposed amend-
ment to a planning, zoning or building code ordinance which can be used to
implement Chapter 129 by any countY. The whole ordinance would, of
course, be used in those counties which do not now have planning or zoning
or building code ordinances in effect; while the amendment would be util-
ized by those counti.es which do have such codes already in effect. (In
those counties where present ordinances already require issuance of build-
ing or alteration permits, such existing ordinances should be checked to
make' sure that the requirement for legal descriptlon of the property be con-
tained in permit applications, and that a copy of the permit issued be sUp-
plied to the assessor. )

A word or two about the blank spaces in both of the proposed docu-
ments: Anyone of several already functioning county offices can be

utilized for the issuance of these permits--the assessor could issue and
keep his own copy; the county auditor (to whom the public is already accus-
tomed to going for other licenses and permits) could issue; the county
engineer could issue and thus be in direct touch with new construction which
will have some bearing on road needs in various areas of the county! the
planning commission might become the issuing authority; or it could be
entirely feasible to work out a cooperative arrangement with the city clerks
of the towns in the county to accept permit applications from county resi-
dents as well as their own city residents as a matter of convenience to the
public. In any case, however, the important procedure to establish is that
covering immediate transmittal of permit copies to the county assessor~
One other word. Since the purpose of these permits is simply to
provide the assessor with automatic notice of any new construction or addi-
tion to values of real property in the county, every c!ffort should be made
to ensure compliance with the statute. To this end, it is suggested that the
cost of the permits be kept as low as possible, and the penalty for failure
to obtain one be set high. If the permits are to be used to fina.nce later
inspections, a.s might be the case in connection with building codes, the
cost of the permit would necessarily be higher.
The proposed ordinance contains a misdemeanor penalty clause,
which will require public hearing and advertising for not less than ten days
prior to enactment of the ordinance. The effective date is set as
June 9, 1955, which is the effective date of the statute.
