This email is not a response to the letter in full. However, I want to clarify one matter identified in the letter, the SHB Hearing. The parties filed dispositive motions. The SHB sent a memorandum response which I will have forwarded to you. It denied the motions but found that Jefferson County did not approve the SSDP by final action because it failed to follow the procedure for approval of same prior to sending the application to the DOE. The hearing itself has been continued with a view to obtaining a formal opinion embodying the conclusions of the memorandum opinion. You may check this with David Alvarez. I have copied him.
