Thanks, Barbara: I have a couple of suggestions on the staff report.
First, the appeal would be to Superior Court only. There is no
appeal to the Shorelines Hearings Board, because there is
no shoreline permit decision being made here. Second, I saw one typo
-- legal council should be changed to legal counsel. Please call me

The Agenda Request for the BoCC to consider the amendment will be before the commissioners at 8:00 AM,
Monday 5.22.06. If they have any questions, AI and I will be there to answer their questions. The memo providing
staff recommendations recommends that the BoCC review the suggested amendment, give public notice and hold
a public hearing. It is also our take on this that SEPA has already been satisfied through the previous SEPA
process for the conditional use permit, as there is no new information or substantive changes to the original
proposal.
Attached is the memo and Agenda Request I prepared for the BoCC to review. This is included in their packets
along with your tracked copy of the revised amendment (5/17/06), the untracked revised copy, various applicable
sections of county code, the series of hearings examiner decisions, and the recent shoreline hearings board
decision.
The controversial part of their actions will take place after Monday, with public notice and the public hearing. So,
my guess is that you wouldn't necessarily need to be there, unless you feel we have it wrong. You might want to
take a look at the attached DCD for Final Docket memo, to help make your decision abouL~arrEM

The County has hired me as lead planner for the Port Ludlow Master Planned Resort. In the future, could you
include my email address in future messages regarding action on cases in the Port Ludlow MPR boundaries? I
believe others have brought me up to do so far and your proposed amendment has been taken over to the
courthouse for the May 22, 2006 Board of Commissioners meeting. We are requesting that they review this for
public notice, public hearing and action.
