SUBJECT: Recommended Decision Procedures re: Suggested Amendment to the
Port Ludlow Master Planned Resort Development Agreement to Allow Timeshare Use for
Tract E; Port Ludlow Associates, MLA06-00221 (GMA 36.70Band JCC 18.40.850-890

STATEMENT OF ISSUE:
The County has received a suggested amendment to amend the Port Ludlow MPR Development
Agreement to change the language and development standards to allow timeshare use in Tract E at
Ludlow Cove.
This suggested amendment from Port Ludlow Associates (PLA) defines new terms and changes to the
Development Agreement to allow timeshare use for Tract E, a 14.66 acre portion of the Port Ludlow MPR
in Ludlow Cove, and changes the Tract E Development Standards accordingly. PLA directs us to the
Port Ludlow Development Agreement (PLDA) Section 3.11 on Flexibility Objectives, Section 3.13 Vesting
of Development Standards and Mitigation, and JCCC 18.40.850.
The attached materials provide background information.
ANAL YSIS/STRA TEGIC GOALSIPROS and CONS:
Staff analysis and recommendations on this amendment are included in the attached DCD memorandum
dated May 10, 2006.
FISCAL IMPACT/COST-BENEFIT ANALYSIS:
The project proponent will be charged an hourly fee to cover staff time required to review and process this
amendment.
RECOMMENDATION:
Staff considers this application to be a Type C County Commissioner Decision, under the Land Use
Procedures Ordinance #04-0828-98, Section 16. Staff recommends that the SoCC accept this proposal
for review, hold a public hearing, and seek legal council prior to taking action.
