At Marco de Sa e Silva's request, I have reconsidered.
Most important is the BOcc's adoption of Ord 08-0710-06 that became effective this
morning. That ordinance and the Maranatha Mining case together with all of its follow-
up cases, make it clear that the Hearing Examiner has original jurisdiction and any
appellate body is strictly limited to a "closed record (administrative) appeal".
