Thanks for the quick answer but that is not consistent with what John Fischbach promised at the July meeting of
the PL VC. He stated that Jefferson County would seek an outside opinion on the legality of using the
Development Agreement Amendment on modifications necessary to allow Trendwest to development in Tract E
of Ludlow Cove. I assume that John will keep his promise made to the PLVC. There are many of us who believe
that the use of the Development Agreement Amendment is not legal.

The hearing examiner, Stephen Causseaux, the new Hearings Examiner for Jefferson County will be listening
to the arguments on the Amendment and the Shoreline Substantial Development Permit and the BoCC will be
considering the recommendations made by the HE on both issues and listening again to arguments on the
amendment before making their decision on the amendment.
An opinion outside this process is not being sought. I hope this answers your question.
