It is my interpretation that it the Development Agreement states that as a Type C, the BoCC may refer the application (which in this case is a consolidated application for amendment and shoreline permit) to the HE for an open record hearing. The BoCC has done this and this is why we tend to see him as hearing both. However, I can see where there is a question because Type C definitely refers to a "land use application" - is this where the question comes in as to whether the HE hears the legislative decision (i.e. amendment)?
