Fischbach Clerk of the Board: Lorna Delaney MINUTES Week of September 25,2006 In the absence of Chairman Johnson, Commissioner Sullivan called the meeting to order. Commissioner Patrick M. Rodgers was present Proclamation: Commissioner Rodgers moved to proclaim October 1 - 7, 2005 as Mental Illness Awareness Week. Commissioner Sullivan seconded the motion. The motion carried. Laurie Strong of Jefferson Mental Health and Judy Tough, member of the Jefferson County Peninsula Regional Support Network Advisory Board were present to accept the proclamation and thanked the Board members for their support of this very important issue. Planning Commission Recommendations for the 2006 Comprehensive Plan Amendment Docket: Director of Community Development Al Scalf introduced Development Services Manager Stacie Hoskins and Assistant Planner Rachel McHugh. Ms. McHugh stated that included in the Board's packet is the Planning Commission report dated September 14, 2006. The integrated staffSEPA report was provided previously on July 19, 2006. Both Staff and the Planning Commission are recommending approval of the four (4) site specific amendments to the Comprehensive Plan included in the integrated staff report. The fifth amendment on the docket #MLA06-87 regarding the Master Planned Resort requires an independent environmental impact statement, so it is not included in either of these reports. The Board has the option to accept the recommendations or to hold its own public hearing on the proposed Comprehensive Plan amendments. The Board is not required to hold a hearing unless the Board chooses to diverge from the Planning Commission's recommendations. The earliest the Board could hold a hearing is October 16,2006. Commissioner Sullivan stated that the Planning Commission has held hearings on these proposed amendments which have been thoroughly reviewed and there seems to be consensus for approval. Commissioner Rodgers agreed and stated that the Planning Commission represents the community and has done the work. He does not see a need for an additional hearing. Commissioner Rodgers moved to have staff schedule the Planning Commission recommendation for the 2006 Comprehensive Plan Amendment Docket for approval on the Consent Agenda for the October 2, 2006 Commissioner's meeting. Commissioner Sullivan seconded the motion. The motion carried. Application to the Washington State Department of Ecology for a Water Right; Northwest Kiwanis Camp, Applicant: Central Services Director Allen Sartin presented a request from Northwest Kiwanis Camp for the County's support and approval to submit an application to the Department of Ecology Page 1 Commissioners Meeting Minutes: Week of September 25,2006 ;~~ ~ .flf,,,,,,\ for water use expansion at Beausite Lake. He explained that because the property is owned by the County, the application must be signed by the County legislative authority. Commissioner Rodgers asked ifthere is the capacity to expand the water use? Mr. Sartin replied that the well is 220' deep, however, the State will need to make that determination. Commissioner Rodgers moved to sign the application form which will be submitted to the State. Commissioner Sullivan seconded the motion. The motion carried. Commissioners/County Administrator's Briefing Session: County Administrator John Fischbach briefed the Board on the following items: · As part of lawsuit filed against the County it is claimed that the Prosecuting Attorney is the only other party who can attend Executive Sessions of the Board of Commissioners. However, a publication from the Municipal Research and Services Center titled "The Open Public Meetings Act", states that "Attendance at an executive session need not be limited to the members ofthe governing body. Persons other than the members of the governing body may attend the executive session at the invitation of that body (RCW42.30.1101(1)(i). Those invited should have some relationship to the matter being addressed in the closed session, or they should be attending to otherwise provide assistance to the governing body. For example, staff of the governing body or of the governmental entity may be needed to present information or to take notes or minutes. However, minutes are not required to be taken at an executive session." · The burn ban in Jefferson County has been lifted but, may need to be re-instituted. · Jefferson County is unable to establish a law enforcement Civilian Review Board similar to one in King County, because it is not a "Homerule" County. · He attempted to contact Hearing Examiner Irv Berteig who was out all last week. Contact will be made this week upon his return. · Representatives from Habitat for Humanity contacted the County regarding purchasing certain parcels from the County. Upon researching the matter it was learned that the County can lease property to a Housing Authority or Non-Profit organizations for up to 75 years for the purposes of providing affordable housing, however, there is no provision for selling property to provide affordable housing. · The Trendwest hearing did not occur because of failure to post proper notice. The hearing will be rescheduled for sometime in November. · A new concept for the visitor's center has been discussed. A potential site with a house on Highway 104 may be available for lease. · He will be meeting later this week with the Jefferson County Historical Society to discuss the use of LTAC funding. · On October 9th there will be a public hearing on a Comprehensive Housing Needs Assessment and Action Plan. The Board is invited to a consultant presentation during a Planning Commission meeting on October 4, 2006. · He presented a copy of the following letters and e-mail: a letter he sent to Bruce Forman regarding a Boundary Line Adjustment for property in Ocean Grove Subdivision; a letter he sent to Lorna Ward regarding Quilcene School District sports tower; and an e-mail to Julia Patterson, King County Page 2 Commissioners Meeting Minutes: Week of September 25,2006 " Councilmember, King County Board of Health Chair about the Washington State Association of Local Boards of Health Inquiry. · During the E-911 outage that occurred last week it was discovered that the E-911 system was not "looped" because an agreement was not in place between Qwest and another agency or telephone company. This is now being taken care of and no messages were lost during the outage. · At the Peninsula Regional Transportation Planning Organization (PRTPO) meeting in Shelton last week is was confirmed by the Hood Canal Bridge Project Manager Eric Soderquist that federal funding for mitigation of the Hood Can Bridge project can be used for permanent infrastructure improvements as well as temporary improvements. · Commissioner Sullivan reported that he spoke with a representative from the Department ofFish and Wildlife regarding the relocating of the Elk in Sequim. The Department is working with the tribes on other alternatives which indicates that the elk may not be relocated to Jefferson County. The public comment period is open until September 30, 2006. Public Comment Period: The following comments were made: Appreciation for the Board's support of trails in Jefferson County, and it is not necessary that trails be constructed with road building machinery or that they be 16' wide, and a request that a policy be instituted for enhancing trails and that federal standards be changed and minimized for rural and environmentally sensitive areas; an individual should not have to ask twice to get public records, and concern about a Commissioner's letter to the editor; relocating elk is not a good idea, it can destroy water quality and historically it has been shown to ruin herds; it is a felony to destroy, alter or otherwise change or delete a public record, punishable by five years in prison/$10,000 fine; any document that involves a government function is public record no matter where or on what computer the business was conducted; concern that the sign ordinance which includes the 4'x8' size restriction was discussed on a Wednesday and did not allow for public comment; Both the Critical Areas Ordinance and Shoreline Management Master Program update need timelines and there needs to be clear understanding of the legitimate basis for the creation of new critical areas since not all shoreline areas need to be considered critical areas for purposes of GMA; Some meetings concerning natural resources are overlapping making it difficult for citizens to cover each issue. Commissioners P.O. Box 1220 Port Townsend, W A 98368 Dear Mr. Johnson: I don't know if there is camaraderie or enmity among you, but I am writing the same letter to all three of you. And, I couldn't begin to guess about the varying motives that underlie the machinations behind governmental scenes, but we hope and pray that a reasonable degree of humanity yet prevails in Jefferson County. It is in this light that we ask you to correct the current deplorable funding status of the Jefferson Co. Animal Shelter. We assume you are men of good will and good judgment and will come up with a practical funding that will make the Jefferson Co. Animal Services a first rate animal control services operation. The current situation is an appalling stigma on Jefferson County and should be embarrassing to anyone who has been involved in the decision making process on this issue. We understand the financial squeeze you are in. Our federal government has bankrupted America from top to bottom, but please adjust your priorities and make every effort to truly, adequately save Animal Services.
