Amendment No.1 to Port Ludlow Development Agreement
Dear Mr. Casseaux,
In response to my earlier letter advising all ofthe parties of the dates I am available for a
continued hearing, 1 received the attached email from Marco de Sa e Silva, counsel for
Port Ludlow Associates (PLA). 1 am quite astonished by his response since (I) I am a
party to both the Galt decision and the Superior Court action originated by Mr. de Sa e
Silva on behalf of PLA which would have resolved this is issue if it had been pursued,
and, (2) this is only an issue since his client requested the continuance to correct an
oversight on their part in posting notice of the hearing.
Given that PLA has not expressed or demonstrated any urgency in pursuing resolution
and that the continuance was precipitated by their oversight, I respectfully request that the
hearing be sc duled on a date when 1 am available.

Barbara: PLA objects to the setting of this hearing around the schedules of members
of the community who intend to offer testimony for or against the proposal. Mr.
Hale is not a party to the application, and he has no standing to dictate the
hearing schedule. In any event, helis represented by legal counsel, and if he is
unavailable on the day of the rescheduled hearing his attorney may represent him,
or he or she may submit written mat~rials. PLA did not ask for a continuance for
its own convenience; it did so to rrl solve a question about public notice of the
hearing, to ensure proper notice of the hearing.
