The only clearing and grading that is going on are on parcels for which we have recently (10/21 and 10/26) issued building permits for the construction of single family dwellings along Ebb Tide Court. There is no clearing and grading on the Trendwest site. However, Seton's construction trailer and heavy equipment (associated with road improvements) has been removed and you will be happy to know that PLA has reseeded and placed straw over the Trendwest site to protect the adjacent waters and wetlands from sedimentation. This is best management practices following the movement of heavy equipment and a construction trailer once on the site. The trailer and heavy equipment were on the site to serve the County road improvement project, a project that has been in the making for a decade, in order to better serve the public safety of Port Ludlow residents approaching a congested business area. A road approach was also created onto the Trendwest site, and was permitted for. This was also in accommodation to the road improvement project. Basically, this property once used as a log dump, was previously cleared and filled many years ago. Judging from the pictures taken, the areas referred to as "cleared" were the cleared areas used for staging various logging activities many years ago. Cleared areas also include the trails to the beach and pathways that have already been on the site, such as the trails run along the shoreline, around the wetland and off to the Gazebo. These were also put in place a long time ago. What looks like grading is the seeding and straw laid down. Once again, these are best management practices. Clearing and grading permits are stormwater permits. PLA, under the PL Development Agreement, fall under different stormwater rules. Despite that, they have an approved stormwater plan on file with Jefferson County for all of the Ludlow Cove Development sites. Calling these clearing and grading violations is a true misnomer. The real clearing and grading is going on at places permitted for building on Ebb Tide Court. These permits were issued over the last two weeks for single family residences. As far as we can see, there has been no violation and no call for a cease and desist order, at this time.' Barbara Nightingale M.MA, MAS. Since this property abuts a salmon stream, wet lands and more than a thousand feet of shoreline, isn't a permit required? In searching the County's web-site, I could not locate any approved permits. Also, doesn't the HE have to approve this development prior to the County issuing any permits? I look forward to your response. They relate to SMA, SEPA, lCAD, and construction issues affecting the use of Ludlow Cove II as a Trend West cite and the effect it could have on the estuary to Ludlow Creek. They update and are not consistent with similar information provided by the applicant. They should be considered before issuing an SSDP, approving DCD's threshold decision to use the MDNS from SUB05-00004 to comply with SEPA for MLA06-00221, and the approval of Proposed Amendment No.1 to the Development Agreement. I ask that these materials be included in the log for MLA06-00221.
