In May of 2005 the Port Ludlow Village Council instructed its President to send
a letter to Jefferson County expressing its support for the proposed development of a
timeshare resort on the Ludlow Cove 2, Tract E (Log Dump) site by
WorldMark/Trendwest. The letter, however, was not to be sent until Trendwest had
agreed to a set of CC&Rs on the property that would be consistent with those that govern
most of the other properties within the Port Ludlow MPR. This would protect the Port
Ludlow Community in the event that WorldMarklTrendwest ever decided to sell the
property,
A draft set of CC&Rs was sent to Trendwest. They replied with an analysis of
our proposed CC&Rs asserting that all of the items included were already covered by
restrictions placed on them by the Master CC&Rs for W orldMark, the Developent
Standards and Design Guidelines contained in the Development Agreement, and also by
the 36 conditions set down in the County Recommendations and approved by the Hearing
Examiner.. They did, however, indicate that they could not agree to an additional set of
formal CC&Rs on the property.
The Community recognizes that W orldMark/Trendwest has an exemplary record
of community involvement and of maintenance of their many properties. Our only
concern is to be protected from changes that might be made by any future owner.
When Trendwest filed a new proposal to use the flexibility clause to amend the
Development Agreement to permit timeshares on the property we resumed discussions
with them with regard to potential CC&Rs. They have been very cooperative, and the
discussions have gone very well. We appear to be making good progress. They have now
agreed verbally to file CC&Rs and we are optimistic that we will be able to reach
complete agreement in the very near future
