I am forwarding an inquiry that I have made of Jefferson County on the MERU count and its allocation to the
proposed Trend West project. I have only fragmentary information relating to DOE standards in 1999 and current
or even to 1985 and 1992, I am trying to understand whether it is proper to make a one to one allocation of
MERU to a Trend West resort unit considering that the use of the Trend West unit is transient, averages three
days, and averages three or more occupants per unit. If the original MERU were based on some other analysis,
for example, a lower intensity based on second home use or retiree use, the conversion may not be proper. Port
Ludlow is served by an aging sewer system originally installed in the 1960s, I live in one of the townhouses, the
low point in Port Ludlow, In other words a failure could affect my unit. I want to be sure that the proposal is
based on an allocation that is justified by its actual nature and not some casuistic definition of "is",
I would appreciate input as to citations for the standards and any other information you might have that would
help me to understand these issues, .

To avoid more confusion, I would like a copy of the MERU count as maintained under MPR Code Sec, 3,802 with
an indication of entries provided therein, I also want to make sure I understand the basis for the MERU count. It
appears to me to be based on a nominal 200 gallons of sewage per household per day, See MERU Sec,3,803
(1), That I understand is derived from the DOE's Attachment 1, Criteria for Sewer Design (1985) and (1992),
Here is my concern, Hotel and motel use has a different standard. Under those publications, it appears to have
been based on 130 gallons per day per room, My understanding is that the Trend West facility is based on a two
bedroom model with three or four rooms total. Don't we have a substantive problem here if you are converting
MERUs to Trend West units on a one to one basis? I think we all know that the proposed use is a private hotel,
not traditional residential. Even Trend West's architect confirmed this in his letter to AI of November 2004 for IBC
purposes, He asked that Trend West be classified as R-1, a designation that applies to hotels and not R-2 a
designation that applies to residential including traditional vacation time shares, AI concurred with the architect.
The architect's analysis was a basis for Mr. Galt's conclusion that Trend West is transient use, like a hotel.
Ignoring zoning for the moment, I think DCD has not provided the proper foundation to determine whether the 120
MERU allocation is adequate for the Trend West Resort, Before the record is closed on this matter, I want a
response from DCD analyzing the MERU allocation to Trend West based upon the use that Trend West describes
in its literature on its web site, in its promise to hire 35 to 40 full time employees, a number consistent with a
hotel, in its architect's report, and in Mr. Galt's decision, I want the analysis to be based on the last DOE standard
as well as the DOE standard in effect in 1999 when the MPR Code was adopted, I am forwarding this email to
Mr, Stewart to make a similar inquiry about the MERU count and the conver~ion, What we have here is a health
and environmental issue, It should be addressed properly, Vesting does not trump this issue, See Development
Agreement, Sec, 3,13,1.

Further to assist my analysis; please provide the correspondence and file information that related to the initial
computation and calculation of MERUs for purposes of including Chapter 3,800 in the MPR Code,

I just reviewed my MERU files and noted in a fax AI sent to me on 10/11/04 that the MERU
report attached contained the following qualific~tion: "Statistical analysis accurate as of
04/01/2003", Do you consider that a 2004 report?
Also, the report [as of 4/01/03] indicated "Total allocated MERU's" 2,321 and 254 unallocated
for a total of 2572 MERU's,
I am looking forward to reviewing all the MERU reports prepared after 4/01/2003.

As you know ordinance NO. 08-1004-99 [Section 3.802 MERU Record:] requires the following:
"A system shall be established no later than 60 days from the effective date of this
ordinance that provides an up-to-date count of available MERU's, This system shall
maintain a current count, shall be available to the general public for inspection during
regular business hours, and shall be updated as needed to reflect current usage and allocations
of MERU's." "The department shall maintain records of ERU and MERU allocations and shall
maintain a matrix showing allocation of residential and commercial MERU's."
To date the Jefferson County Department of Community Development Official MERU Records
only have published reports on the following dates:
01/05/2000
06/05/2001
11/06/2001
04/17/2003
11/10/2003 [note: prepared by Larry Smith / PLA]
Please let me know when DCD will come into compliance with Section 3.802:
