Barbara:
Perhaps you didn't understand my email. I am an interested party. I have a right to provide oral and written
testimony. I have instructed you that my written testimony includes the entire logs identified in my email. I am not
going to guess which items you or the applicant intend to attach. I want confirmation that you have attached the
items I have requested be attached. If they are not attached, it provides a procedural basis for having the results
of the hearing process set aside administratively and under LUPA. I am not interested in playing games. I have
devoted significant time and treasure to the pursuit of my legal rights in this manner. I expect the County to
accord me the same deference that it accords the applicant, any other party, or any government agency.
I wish to raise one more question. I saw no inquiry of the County Sheriff. He made no response. Is there a basis
to exclude comments from the County Sheriff to the pending application? Please consider that the issues raised
by the County Sheriff in response to SUB 05-00004 questioned the adequacy of police protection in the MPR.
Those issues are pervasive. They affect SEPA and the GMA. I am entitled to see that they are addressed.
If you have made inquiry in connection with MLA 06-00221, please identify the log number. I appreciate your
assistance.
Thank you,
Les

Les,
The County handles the provision of appropriate files to the Hearings Examiner pursuant to County policy and

Barbara:
Judging from DCD's treatment of SEPA issues there is considerable crossfertilization between SUB05-00004
and MLA06-00221. I know that DCD's position is that the same substantive project can utilize the prior log
interchangeably. I dissent this view. Nevertheless since it is the view of DCD and probably the applicant and
since there is obvious cross fertilization of individual log items between the filings, to avoid confusion, I request
that the entire file for SUB05-00004 be included as part of the log for MLA06-00221.
I also want a complete copy of the Development Agreement with attachments, Recording File No. 435974 and
the PL VC CC & Rs, Recording File No. 435975, included as part of the log for MLA06-00221.
